RESULT: APPROVED [ UNANIMOUS] MOVER: Dennis Reeves, Council Seat 3 A SECONDER: Trey Goodwin, Council Seat 4 AYES: Griggs, gossom, Reeves, Goodwin, Nabors, Rigdon, Rynearson h IflV, pproval of a Site Development Plan for Old Fort Walton Subdivision The City Attorney advised the following three agenda items fall under a quasi- judicial proceeding and gave the oath to those who planned to testify on these items. He asked for any ex -parse communication from Council on these items. Council advised they spoke with Mrs. Bowen on the matter. Ms. gossom stated she had a conversation with two of her neighbors regarding the issue, but spoke to one else. Ms. Jones advised the request is for approval of a site development for Old Fort Walton Subdivision, a six -lot single family residential subdivision at the intersection of Pryor Road SE and Brooks Street SE. The Development Order was entered into the record. Ms. Jones continued the proposed development is consistent with the City's Comprehensive Plan and meets the minimum requirements of the City s Land Development Code, and that the MPB recommended approval at their December 1, 2011 meeting, and that Staff recommends approval as well. Benny Bowen, 361 Brooks Street, expressed concern that the home proposed for Lot 1 does not lace Brooks Street and that his family will be forced to look at the neighboring backyard from the inside of their home, thus downgrading the value of his home. Dorothy Bowen, 361 Brooks Street, objected to the homes backing up to her property and requested that the developer meet with the Board of Adjustment to obtain a variance so the home could face Brooks Street . Council discussed the issue at length including the rights of property owners vs. homeowners; historical nature of the property and the neighborhood; and the aesthetics of the neighborhood. The City Attorney advised that since the project meets the requirements of the City, Council should vote for it, although they can vote against it if they feel inclined to. He cautioned, however, that if denied the developer does have the right to repeal the action and seek recourse. The vote on the motion to approve the Site Development Plan and Development Order for Old Fort Walton Subdivision at the intersection of Pryor Road SE and Brooks Street SE carried by a vote of 5 to 2. The findings also included the need to involve first responders and the Okaloosa County School District and the residents in planning, design, and operational implementation for the area. The City's Police and Fire Chiefs expressed concern of response time for emergency personnel if streets were closed. Jay Harshman, 512 Mooney Road, discussed the need for drivers to pay attention and that speed is not always the main reason for accidents. Ross Hamilton, 414 Pelham, noted that to reduce risk of accidents people need to act and drive responsibly and suggested a temporary closure of Country Club. Linda Bowman, 631 Country Club, stated she does not want more studies and would like to see something done. Billy Walker, 635 Country Club, also feels another study is not warranted. Judy Klug, 607 Country Club, stated that cars do not stop as they turn onto Country Club from Mooney Road. The resident of 646 Country Club, echoed comments about the study and data but questioned when do the studies end, and that something needs to be done, and agrees the road needs to be closed. John Culberson, 641 Country Club, suggested rearranging three holes at the golf course by Denton Blvd which would rearrange traffic. He was advised that the deed restrictions on the golf course are for educational or recreational purposes only. Mr. Rigdon moved to temporarily close Country Club Avenue for 30 days at both ends. Mr. Griggs seconded motion. Several Council members spoke in support of speed tables, a long -range plan for improving Country Club, adding curbing or sidewalks, but would not support closing the road. Upon questioning, Mr. Beedie responded that an estimated timetable to implement modified speed bumps would be about 60 days, with 30 days to inform the residents, receiving the materials in 2 or 3 weeks, and installing 2 to 3 a day. Mr. Rigdon withdrew his motion. Mr. Griggs withdrew his second. Mr. Reeves moved that the City move forward with installing speed tables on Country Club Avenue as recommended by Staff, with a 60 -day deadline to have the task accomplished, and in the next 90 days include a long -term traffic evaluation and put together a plan for curbing and sidewalks on Country Club as a budget item and to include the cost. Mr. Rynearson seconded motion. City Council ofFort Walton Beoch Page 4 Printed 1211612011 197 Minutes December 13, 2011 Roeular Meeting 5. Award of RFQ Award of the design criteria package to replace the Hedrick Recreational Center and Complex improvement to Hatch Mott MacDonald of Pensacola, Florida. Michael Beedie, Engineering(Utilities Director, advised an RFQ was issued to provide a design criteria package for replacement of the Hedrick Recreation Center, and nine vendors submitted proposals. An Evaluation Committee reviewed the proposals and heard presentations from the top three -ranked firms, with the firm Hatch Mott MacDonald being chosen as the highest ranked Linn. Staff requests City Council to authorize the City Manager to negotiate and execute a contract with Hatch Mott MacDonald to develop a design criteria package for replacement of the Hedrick Recreational center, and if a contract cannot be negotiated with the highest ranked vendor, to begin negotiations with the next highest vendors in order of ranking until a contract can be executed. Discussion was held regarding the differences between the Design -Build vs. Construction Manager at Risk procurement methods for the project. Mr. Beedie advised the City is pursuing the Design -Build method per the direction of City Council from the August 2011 special meeting on the project. Dan Keck of Hatch Mott McDonald explained their role is to put together a design criteria package to make sure the goals of the City are achieved so the project can be completed. Mike Brassard of Hatch Mott McDonald clarified a Construction Manager at Risk method provides that a contractor gives a Guaranteed Maximum Price at risk managing construction and working with an architect, whereas the design criteria package provides various contractors teaming with other professionals to do a design project. Charles Baxter of Hatch Mott McDonald advised they have worked with the City in developing the Design -Build concept but changes can be made to the design within approval by the City. Upon questioning, Mr. Beedie advised the time frame would be about 2 to 4 months if the City decided on the construction manager procurement process. The vote on the motion to authorize the City Manager to negotiate and execute a contract with Hatch Mott MacDonald to develop a design criteria package for replacement of the Hedrick Recreational center, and if a contract cannot be negotiated with the highest ranked vendor, to begin negotiations with the next highest vendors in order of ranking until a contract can be executed, carried by a vote of 4 to 3.
