READING 1st 2nd ORDINANCE 1703 AN ORDINANCE OF.TtE CITY OF FORT WALTON BEACH, FLORIDA; RELATING TO THE ANNEXATION OF LOT 3 AND THE SOUTH 30.75 FEET OF LOT 2,BLOCK Sf COUNTRY CLUB ESTATES SUBDIVISION (813 COUNTRY CWB AVENtE NE); PROVIDING FOR AUTHORITY; PROVIDING FOR FINDINGS.OF FACT; PROVIDING FOR PROPERTY ANNEXED; PROVDNG FOR EFFECT OF ANNEXATION; PROVIDING FOR MUNICIPAL BOUNDARY; PROVIDING FOR AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY TIE CITY COUNCIL OF DE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLO\'fS: SECTION I. AUTHORITY. The au1hority for enactment of this 0fdiI8tee is Section 166.021( 1) and Section 171. 044, Florida Statutes, and Section 2 of the City Charter. SECTION D. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach finds the following: A. That an application for voluntary annexation was received by ~ City from Kathi Thomas, owner of the property to be annexed; and, B. That the appticant has provided sufficient evidence of ownership of said property to be annexed; and, C. That said property to be annexed is contiguous to the municipal boundaries of the City of Fort Walton Beach; is an area that is reasonably compact; and is unincorporated territory; and, D. That the annexation of said property will not result in the creation of any enclaves; and, E. That the Municipal Planning Board held a public hearing on May 4, 2006, and folrld that the request was consistent with the Comprehensive Plan and recommended approval of this OIdin8nce, including Exhibit -AM, a location map and Exhibit -8'", a metes and bounds description, annexing said property; and, F. That notice of annexation was duly published once a week for two consecutive weeks in the Northwest Florida Daily News, a newspaper published within the City of Fort Walton Bead1; and, G. Upon adoption, this ordinance shall be filed with the clerk of the Court of 0kaI008a County, the 0kaI00sa County Manager, and with the Florida Depa.b...m of State. SECTION III. PROPERTY ANNEXED. The following described property is hereby annexed to the City of Fort Walton Bead'a: Inslr# 2342576 BK: 2718 PG: 4141. SECTION IV. EFFECT OF ANNEXATION. A. The atea annexed shall be sclbject to aU laws, orcIinanc:es,81d regulatio... in force in the City of Fort Walton Beach and shaI be enIIIIed to the same-privileges and benefita as other parts of the City of Fort Walton Beach upon the effeGtive date of the annexation. B. The area annexed is subject to the 0kaI00sa County Comprehensive Plan and zoning regulations. Said regulations shall remain in fuR force 81d effect until the area is assigned a Comprehensive Plan Futun't la1d Use designation and is rezoned by the City of Fort WaIon Beach to comply with its Comprehensive Plan. SECTION V. MUNICIPAL BOUNDARY. The Municipal boundary lines of the City of Fort Walton Beach shaH hereby be amended to include the annexed plopefty desaibed herein before and in Exhibit "8", at: tad1ed and made a part hereof by .eference, as a metes and bounds description. A map of the annexed area is attached hereto as Exhibit "AM and made a part hereof by reference. SECTION VI. EFFECTIVE DATE.This Ordinance shall take effect immediately upon approval by City Council and the signature of the Mayor.
