COUNTY ADMINISTRATOR'S UPDATE Mr. Padgett stated last week while attending Legislative Day in Tallahassee, several county representatives met with Senators and one of the Governor's representatives to discuss the issues regarding the Department of Juvenile Justice (DJJ). He pointed April 1, 2014 ~1- Minute Book 71, Page 1 Okaloosa County Board of County Commissioners out that Okaloosa County, as well as 25 to 30 other counties, was overcharged by DJJ. Mr. Padgett reported they made the rounds to discuss the illegal DJJ charges and overpayment by Okaloosa County to the tune of $3 Million. He said there was not a good reception on the part of the State to fund DJJ to a point where the counties can be repaid. (Mr. Padgett referred to the court case which found the DJJ charges to be unlawful.) Mr. Padgett said the counties have tried to be reasonable, noting they have not asked for the State to write a check to reimburse them but have asked for a credit over the next few years. He stressed this has been outlined to the State. Mr. Padgett stated the best that is coming out of Tallahassee is possible payback over the next 23-year period. Continuing, Mr. Padgett stated an advertised workshop for DJuU was to be held last Thursday from 9 a.m. until noon and he decided to attend. He listed the items to be discussed on the workshop agenda. Mr. Padgett said that meeting was called to order at 9:02 a.m. and adjourned at 9:12 a.m. He expressed exasperation that a State agency with an advertised workshop and published agenda was only in session for ten minutes. With regard to the Governor’s position on this matter, Mr. Padgett reported that Mrs. Rogers of the Governor’s Office told him the Governor will wait to see what comes out of the Legislature. He said the Board will have to make a decision on what course to pursue after the Legislative Session ends. COMMISSIONER'S MINUTES Mr. Harris stated, “It is April and we are the fools.” Mr. Amunds commended Public Works for the work being done at Veterans Park on Okaloosa Island. Mr, Boyles advised he has nothing. Mr. Parisot stated there was an editorial in the Sunday edition of the newspaper which reported the State has an excess of $1.2 Billion. He felt repayment to the counties for overpayments to DJJ could be taken from this surplus. Mr. Windes stated Elder Services has requested he become the liaison commissioner to the organization and advised he will fill that position. April 1, 2014 -2- Minute Book 71, Page 2 Okaloosa County Board of County Commissioners PUBLIC COMMENTS RELATING TO AGENDA Mr. Harold LaFountain, Crestview, stated there are several requests on today’s agenda for use of public beaches. He said it would be nice to know how much these groups pay to use the beaches. Mr. Parisot responded the fees are listed on the permit requests in the on-line agenda package. Mr. LaFountain replied that he does not have internet service. VISITORS - SHAUN MAY AND KATIE HOLBROOK, FLORIDA DEPARTMENT OF HEALTH, REQUEST FOR CONSIDERATION OF MEMORANDUMS OF AGREEMENT Mr. Shaun May and Ms. Katie Holbrook, representing the Florida Department of Health, came forward to discuss consideration of the county entering into two Memorandums of Agreement (MOAs). Ms. Holbrook said the MOAs would be for emergency public health situations. Mr. May said their proposal is for use of the Emerald Coast Convention Center (ECCC) and the Boardwalk on Okaloosa Island as Strategic National Stockpile Points for dispensing medicine in the event of an emergency public health issue. He clarified the emergency situation would be the next level above the H1-N1l event a few years ago. Mr. May stated distribution centers would be set up throughout the county and these two points would serve South Okaloosa County. He said it is not for an exercise or “table top” but would be for actual activation. Mr. Amunds made motion, seconded by Mr. Parisot, to approve the MOAS. Mr. Boyles stated Mr. May and Ms. Holbrook did a great job and noted the internal coordination sheet for the Health Department was signed off by nine individuals. He advised the problem is these documents have not gone through the county’s review process. Mr. Boyles pointed out the Tourist Development Department, which oversees the ECCC, was not in the loop and did not know this item was coming before the Board. He also pointed out one of the proposed MOAS states it is between the Health Department and ECCC which is not appropriate and should be between the Health Department and Okaloosa County. Mr. Boyles recommended the proposed documents go through the county's internal review process and follow up with approval of the documents on the Consent Agenda at a future meeting. Mr. May said there must be some miscommunication because their intent was for county review with approval at a future date. He added the correction Mr. Boyles mentioned has already been made. April 1, 2014 -3- Minute Book 71, Page 3 Okaloosa County Board of County Commissioners In response to this discussion, Mr. Stewart came to the dais (8:55 a.m.) and stated he is aware of the issues and stated county staff will review the documents. Upon inquiry by Mr. Windes, Mr. Stewart suggested no action be taken today. Mr. Amunds withdrew his motion and recommended the proposed MOAs be routed through Public Safety. Mr. Boyles responded the MOAs should be routed through all appropriate departments according to policy. Mr. Parisot made motion, seconded by Mr. Harris, to table consideration of this item. Ms. Holbrook stated she did catch the error referenced above and supplied corrected documents to the county. She added that she spoke with Bill Leaman, ECCC Manager, and James Puckett of the Parks Department last August about this proposal, advising they were aware of it and were supportive. 5 yeas. PUBLIC HEARING - RESOLUTION SUPPORTING ISSUANCE OF $6 MILLION OF UTILITIES SYSTEMS REVENUE BONDS, SERIES 2014 FOR AUBURN WATER SYSTEM Mr. Stanford read the advertised legal notice for public hearing to consider adoption of a resolution approving the issuance of $6 Million in Okaloosa County Florida Utilities System Revenue Bonds, Series 2014 to be loaned to the Auburn Water System for the purpose of financing all or a portion of the costs for acquisition, construction and equipping of improvements to the utility. Mr. Boyles stated the Auburn Water System is a client of his law firm and he will abstain from participation on this item. Mr, Mark Mustian, attorney with Nabors, Giblin & Nickerson, stated the proposal was brought to the Board earlier in the year. He said this is a tried and true process and the county would be a conduit for the bonds. Mr. Mustian stated the action does not impact the full faith and credit of the county. He explained that Auburn Water System (AWS) is a private entity and must go through several processes for bond issuance and this public hearing is on step in that process. Pursuant to the IRS Code, the county must approve the bond issuance and AWS will apply to the State for the funds. Mr. Windes opened the floor for public comment. There was none.
