BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: March 19, 2013 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Public Hearing - Regatta Bay Master Plan DEPARTMENT: Growth Management BCC DISTRICT: Five ISSUE: 362975-BCC-2013. Consideration of a request amending the approved Development Order for the Regatta Bay PUD Master Plan as submitted by Tom Patton as agent for Robert J. Guidry Financial Services, LLC and Emerald Grande Development, LLC relating to a property located at the north side of Hwy 98 East, west of Legacy by the Bay Apartment Complex, Destin. The property is currently zoned Mixed Use 2 (MU 2) with the Future Land Use Map (FLUM) designation of Mixed Use 2 (MU 2). Property contains 10.35 acres and the overall PUD acreage is 445.65 acres more or less. The requested amendments are as follows: 1. Reducing the number of residential units from 549 (of which there currently exist 335 single family units with 64 additional single family units and a 150 multi-family unit apartment complex approved but unbuilt) to 431 units (the 335 existing single family units plus an additional 64 single family units and a 32 unit multi-family apartment complex for future development) - a reduction of 118 multifamily units. 2. Reducing the office space from 151,500 square feet (116,125 SF existing, 35,375 SF future development) to 116,125 SF (existing), a reduction of 35,375 SF office space. 3. Adding a 209 room hotel with no more than 333,875 SF and a maximum height of 99 feet or less. 4. Minimum parking ratio of 1.1 spaces per unit for hotel and 1.5 spaces per unit for multi- family apartment complex. 5. Waive the setbacks and buffers to the north, east and west sides of the hotel and multi-family apartment complex since the uses and the properties subject to this approval abut open space and have no impacts on the adjacent properties and uses. 6. Extend the build out date to November 18, 2023. STAFF FINDINGS: • The properties are currently vacant and labeled as Future Developments 1 and 2 as noted on the proposed Master Plan. • The owners of the properties are proposing to build a hotel on Future Development 1 and a multi- family apartment complex on Future Development 2. • The requested amendment to the current approval of the PUD Master Plan would allow the property owners/developers to build the requested 209 unit hotel on Future Development 1 and 32 unit multi-family apartment complex on Future Development 2. • The properties are classified “Vacant Commercial and Office Buildings” by the Property Appraiser for property tax purposes. • The existing uses of the adjacent properties are multi-family apartments and golf course to the north and to the east, Highway 98 to the south and to the west is Regatta Bay Boulevard. • The applicant provided a traffic analysis study which shows that the decrease in apartment units and office space offsets the trips from the proposed hotel resulting in no net increase in trips overall. The traffic study was also reviewed by the City of Destin consultant resulting in an approval by the City. PUBLIC COMMENT/OPPOSITION: Three persons spoke at the Planning Commission public hearing expressing concerns about ingress and egress, increased traffic, and reduction of setbacks. MILITARY REPRESENTATIVE: No comment. STAFF POSITION: Staff has no objection to the requested amendment to the Development Order of the Regatta Bay PUD Master Plan. RECOMMENDATION: It is recommended that the Board consider the facts presented herein, the Planning Commission recommendation, as well as any facts that may be presented at the public hearing, and then decide whether or not to approve the requested changes to the Regatta Bay PUD Master Plan. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
