Services for Evaluation and Appraisal Report ( EAR) Based
Subject: Consulting
Amendments to the Comprehensive Plan
1. BACKGROUND:
1. 1 Pursuant to Chapter 163. 3191 of the Florida Statutes, " each local government shall adopt
an evaluation and appraisal report once every seven years assessing the progress in
implementing the local government's comprehensive plan ".
EAR), which
1. 2 In May 2008, City Council adopted the Evaluation and Appraisal Report (
included text and map amendments to the City' s Comprehensive Plan. The City' s EAR
was found sufficient on July 25, 2009, by the Florida Department of Community Affairs
DCA).
1. 3 The amendments to implement the EAR recommendations must be adopted during a
single amendment cycle pursuant to Chapter 163. 3191( 10) of the Florida Statutes. Upon
transmittal of this amendment package to DCA, the Agency will either advise the City
that they will not conduct a review and to proceed with the adoption of the amendment
package or that they are going to conduct a review and will issue an Objections,
Recommendations and Comments ( ORC) Report.
1. 4 On January 12, 2010, the City Council approved the City' s Evaluation and Appraisal
Report ( EAR) based amendment package on first reading and directed Staff to transmit

assigned the package DCA Number 10 -1 ER.
1. 5 On April 5, 2010, the City received the Objections, Recommendations and Comments
ORC) Report from DCA regarding the EAR -based amendment transmittal package. The
City is now in the process of considering revisions to proposed amendment 10 -IER to
address objections in the ORC Report.
2. DISCUSSION:
2. 1 Since the initial prepartion of the EAR -based amendments to the Comprehensive Plan,
Staff has determined that significant changes should be made to the structure and detail
of proposed amendment 10 -1 ER. For example, the framework for land use categories in
95 Council Meeting, June 22, 2010
proposed amendment 10 - 1 ER is complex, and Staff has determined that the required
zoning districts and associated development standards would be even more complex. The
proposed amendment 10 -1 ER reflects an approach with many overlapping layers of
regulation, and approach Staff wishes to reconsider.
2. 2 In order to exepdite the process to revise the the proposed amendment 10 -1 ER, Staff
wishes to engage the services of a professional planner to supplement the work of the
planning staff. ;Staff contacted The Gail Easley Company, which is owned and operated
by Mrs. V. Gail Easley, FAICP, a professional planner with over 30 years of experience
in preparing EARs and EAR -based amendments. Mrs. Easley also provides training on
the preparation of EARs and EAR -based amendments to local governments throughout
the State of Florida and was the primary author of the guidebook provided by DCA to
assist local governments in this process.
2. 3 Staff requested a budget, scope, and schedule from The Gail Easley Company to provide
assistance in revising amendment package 10 -1ER. The Scope of Services includes the
following tasks:.
2. 3. 1 Task 1— Perform a detailed review and analysis of the EAR, proposed
amendment 10- 1 ER, the ORC Report, the Comprehensive Plan, and the Egl in
AFB Joint Land Use Study. Mrs. Easley will prepare a detailed memorandum
with findings and specific recommendations for revisions to the proposed
amendment 10 -1 ER.
2. 3. 2 Task 2 -- Coordinate a joint meeting with the Municipal Planning Board ( MPB),
City Council, and other stakeholders to confirm or revise the recommended
directions for modifying the proposed amendment 10 -1 ER.
2. 3. 3 Task 3 -- Prepare a revised proposed amendment 10 -1 ER for review and approval
by the Local Planning Agency (MPB) and the City Council in order to submit the
revised amendment to DCA.
2. 3. 4 Task 4 -- Facilitate a workshop to present the revised proposed amendment 10-
1 ER to the MPB and City Council.
2. 4 The proposed schedule for the project estimates approximately four months for
completion.
3. FINANCIAL INFORMATION:
3. 1 To complete all of the tasks to evaluate and revise the proposed amendment 10 -1 ER for
the Comprehensive Plan, The Gail Easley Company has proposed a not to exceed fee of
30,000. This includes the fee for all work to complete Tasks 1 through 4 and four trips
to Fort Walton :Beach for meetings with City staff and workshops.
96 Council Meeting, June 22, 2010
12 If additional workshops or meetings are required, The Gail Easley Company has
submitted a budget of $3, 300 for each workshop or meeting.
3. 3 If approved, there is sufficient funding available in the Engineering Services Department
FY 2009 -10 budget due to staffing changes throughout the fiscal year.
4. STAFF RECOMMENDATION:
4. 1 Staff requests City Council authorization for the City Manager to execute a contract with
