READING 1st 2nd ORDINANCE 1808 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA; AMENDING DIRECTIONS - THE COMPREHENSIVE PLAN OF THE CITY OF FORT WALTON BEACH; 2008; DELETING THE CONCURRENCY MANAGEMENT SYSTEM ELEMENT FROM THE COMPREHENSIVE PLAN; PROVIDING FOR CONFLICTS AND SEVERABILITY; AND SETTING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: Section 1. Intent and Authority a. The Local Government Comprehensive Planning and Land Development Regulation Act ( Section 163. 3161 et seq., Florida Statutes, and Chapter Florida 93- 5, Administrative Code), require that each local government prepare and submit amendments to the comprehensive plan of the type set out in the Act. b. On Dezamb f X , 2010, at a duly advertised and noticed hearing, the Municipal Planning Board acting as the Local Planning Agency deliberated upon the requests for amendments as stated in this ordinance to Directions- The Comprehensive Plan of the City of Fort Walton Beach: 2008 and for transmittal to the Florida Department of Community Affairs, and made recommendations to the City Council. C. On 2011, at a duly advertised and noticed public hearing, the City Council conside ed the re mmendation of the Local Planning Agency and the coordination and consistency of the amendment with the other elements of Directions- The Comprehensive Plan of the City of Fort Walton Beach: 2008, and approved such amendments for transmittal to the Florida Department of Community Affairs. d. The City Council has provided for full public participation in the comprehensive planning and amendment process and has considered and responded to public comments. Section 2. Adoption of Deleting the Concurrency Management System Element The Concurrency Management System Element of Directions- The Comprehensive Plan of the City of Fort Walton Beach: 2008, codified as Volume III of the Code of Ordinances of Fort Walton Beach, is hereby deleted in its entirety. Section 3. Conflicting Provisions Provisions of other ordinances of the City of Fort Walton Beach, or parts of other ordinances, in conflict with the provisions of this ordinance are hereby superseded by this ordinance to the extent of such conflict. Section 4. Severability Should any section or provision of this ordinance, or any portion thereof, be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder, as a whole or any part hereof, other than that part declared to be invalid. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. Section S. Effective Date The effective date of this plan amendment shall be: the date a final order is issued by the Florida Department of Community Affairs finding the amendment to be in compliance in accordance with Chapter 163. 3184, Florida Statutes; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Chapter 163. 3184, F.
