One of the conditions of plan approval by the Public Works Department was dedication of property a minimum of five feet behind the south curb line of Brooks Street for right- of-way purposes. The existing right- of-way on Brooks Street narrows to the back of curb at the east end of the development. The surveyor for the development provided a legal description of the needed to create a minimum of five feet of right- of-way behind the property curb in front of the development. In addition to the right- of-way needs along Brooks Street the City requires an easement for installation of sidewalk along Brooks Street as a condition of the development. The sidewalk easement will be finalized and brought to Council for acceptance after installation of the sidewalk, when its exact location can be determined. Discussion: The owner of the property agreed to the dedication of the strip of land necessary to meet the City' s needs and executed a Quit Claim Deed, May 26, 2005, to the City of Fort Walton Beach by MTM Partners, L.L.C., owners of the property. The deed was reviewed and approved by the City Attorney for form and legal sufficiency. Recommendation: Partners, Respectfully request that the City Council accept the Quit Claim Deed trom MTM L.L.C. for additional right- of-way along the south side of Brooks Street in front of the Villa di Mare Condominium property at 240 Brooks Street SE.
