Board FROM: Sunil Harman SUBJECT: Approval to Pay Eglin a Fee for Information DEPARTMENT: Airport BCC DISTRICT: All STATEMENT OF ISSUE: The Board of County Commissioners is requested to approve payment of an $88.00 Freedom of Information Act (FOIA) fee for a copy of the Air Force (AF) lease pertaining to the hotel on Okaloosa Island. BACKGROUND: On October 11, 2013, the Airport requested a copy of the Air Force lease, because it was considering its plan to seek permission to develop a hotel lease on its present leasehold. The purpose was to assess what potential fees and restrictions might be anticipated. On March 3, 2014, the FOIA office notified that the document was ready for release and could be picked up. That same day, the Airport asked for the cost so that a Purchase Order could be prepared before the AF issued an invoice. The AF responded on March 10, 2014 that the Vice Wing Commander's letter dated February 6 "... is as close to an "invoice" as you will get...." That letter was never received at the Airport, but a copy was obtained when the document was picked up. With the information about the charge, a Purchase Order was prepared for payment, but VOIDED by Finance on 3/13/14 as "after the fact." Given the fact that the Air Force prepared the document before an estimate could be established; and that its "invoice" was dated prior to notifying the Airport of the amount to be charged, a "Catch 22" scenario was created whereby there was no way short of an "after the fact" Purchase Order to affect payment. OPTIONS: Approve, Disapprove, or Table. RECOMMENDATIONS: Staff recommends the Board of County Commissioners authorize payment in the amount of $88.00 to the Air Force. I am still unclear as to why Finance voided the purchase requisition. Nonetheless, the County is legally obligated to pay the Air Force. I does not involve any contract payment, but we did agree to pay them the fee. I have included some stuff I got Online about FOIA. We tried to get them to waive it, but they wouldn’t. Sunil thinks we need to get it behind us to maintain our professional relationship with our lessor. I think we need legal concurrence by tomorrow to meet our Wednesday suspense. > > Thanks, > > Jon > Jon Morris, C.M. > Administration & Finance Manager > Okaloosa County Airports > (850)651-7160 Ext 1005 > > > > <FOIA Fee Payment to Eglin.pdf> Page 1 Packet Pg. 141 BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: July 1, 2014 TO: Honorable Chairman and Members of the Board FROM: Roland Sims SUBJECT: Approval of Fiscal Year 2015 1st Quarter Calendars DEPARTMENT: County Administrator BCC DISTRICT: All STATEMENT OF ISSUE: In order for Public Hearings, Workshops and Employee Award presentations to be scheduled for the 1st Quarter of FY 2015, meeting schedules need to be approved and published.
