This time extension includes the nine additional calendar days previously coordinated with the contractor for the sanitary sewer investigation. This time extension applies only to the work items identified in Table 1 above and does not apply to any work items in the contract not listed in Table 1 above. Additionally, any liquidated damages accrued as to the contract items not listed in Table 1 above continue to be assessed and are not waived or released as a result of this change order. It is understood and agreed that the Contractor and Owner disagree about the contract time and liquidated damages. The parties reserve their rights under the contract and applicable law. The terms and conditions of the original contract shall remain in full force and effect and, by issuing this change order, the County does not waive any rights or remedies that it may have under the original contract. The remaining balance of $8,108.00 in the allowance for the contract item entitled “43. Gulf Power Allowance” will be removed from the contract amount. By authorizing this task order, the Contractor agrees to re-issue Pay Application #8, indicating release of one-half of the withheld retainage amount, and authorizes the County to remit payment directly to the identified account of his legal counsel: Baker Donelson Attorney Trustee-IOLTA Account. Within seven calendar days of payment receipt, the Contractor agrees to remit payment of all outstanding amounts owed to subcontractors which have performed services under this contract to date. Upon completion of all work items in the contract and acceptance of the project, the contractor will submit required project close-out documents and the contract final pay estimate (including release of applicable retainage).
