Maitland, Florida, and
further authorize the City Manager to negotiate a contract with Brown and Caldwell for
engineering and design services, construction administration, and permitting not to exceed
the budgeted amount of $840,700.00. Mr. Holmes seconded motion and it carried
unanimously with Holmes, Patterson, Campbell, Tucker, Pullen, Hartwell, and Minich in
favor.
HEIGHT MORATORIUM
Consideration of beginning immediately and continuing for 120 days requiring the City
Administration to not consider and/or forward for consideration by any City board or City Council
any building plans that would exceed the maximum height of 75 feet above mean sea level. As
backup material please include any and all material on this subject that has been presented to City
Council since 1 January 2005.
Dr. Pullen advised he was informed by the City Attorney that to be considered legaily sufficient,
this item would require public input before the Municipal Planning Board (MPB).
Dr. Pullen moved to direct the MPB to study the issue and to bring the item back to Council
at a time when it has been properly advertised. Mr. Tucker seconded motion.
Council questioned the need for a moratorium since Council will not meet until August, and the
study from Eglin is due to the City in July. Dr. Pullen explained his reasoning that it is a work in
progress, and rather than coming back in August to initiate action, this will ensure it is already in
progress.
Discussion included the fact that the problem is not clearly defined, and that the City needs to give
Eglin a chance to complete and forward their report to the City.

HEIGHT MORATORIUM—CONT
The City Manager explained that the issue as presented would have a city-wide impact and
expressed concern about the Kenwood area where the elevation is well above mean sea level.
She also informed that bids are due in on two water tanks well over 75-feet, and the process
could be stopped on the tanks.
6-14-05
Clarification was given that the motion is to direct the MPB to study the issue, not Council taking
action. The City Manager stated since this is a land development code process, an ordinance
would have to be developed and considered by the MPB, advertised, and voted on before brought
back to the Council.
The Mayor called for the vote on the motion and it carried by a vote of 4 to 3 with Patterson,
Tucker, Pullen, and Hartwell in favor and Holmes, Campbell, and Minich opposed.
ORDINANCE RELATING TO MPB AND CRA
Discussion on the development of an ordinance relating to the Municipal Planning Board and the
Community Redevelopment Agency.
Mr. Tucker stated his desire that the Municipal Planning Board be the responsible agency for all
development in the City. It was his feeling that the CRA could make recommendations, but the
MPB should be the final authority. He asked if this action would negatively impact the City.
The City Manager advised the purpose of the CRA is to review site plans for compliance with the
Urban Master Plan and the CRA Plan, and plans do not go to MPB because Staff reviews from a
technical standpoint to ensure they are in compliance with the LDC. She stated that for a site plan
to go from CRA to the MPB then to Council would be another step for developers to go through to
get projects approved. Also, there are many site plans that are reviewed at Staff level that do not
go before the MPB, such as residential homes.
The City Manager reported that the MPB had requested they have an opportunity to look at all site
plans going before the CRA Board for information only, so they are aware of issues and what is
being planned in the CRA area.
Mr. Tucker was satisfied with the fact the MPB would receive the information.
PURCHASE OF DEFIBRILLATORS
Consideration of a request to purchase six (6) automatic external defibrillators at the unit price of
$1,795 in the extended amount of $10,700, for key municipal facilities including City Hall/City
Auditorium, Fred Hedrick Recreation Center, Golf Club Clubhouse, Police Building, City Yards
Complex (Purchasing Building) and the Senior Citizen Center.
The City Manager advised that grants have been applied for in the past requesting funding for the
purchase of the defibrillators, and the City has been unsuccessful in receiving the funds, and
stated the importance of having the defibrillators in the municipal facilities.
Mr. Tucker moved to authorize the City Manager to purchase six Automatic External
Defibrillators at a cost not to exceed $10,770.00. Mr. Campbell seconded motion.
Council received clarification that the Fire Department will be responsible for the security and
maintenance of the defibrillators, and that City Staff will be taught how to use the defibrillators.
The Mayor called for the vote on the motion and it carried unanimously with Holmes,
Patterson, Campbell, Tucker, Pullen, Hartwell, and Minich in favor.

SPECIAL ASSESSMENT—FIRE SERVICES
Consideration of request authorizing the City Manager to issue a request for proposals seeking
consultant services to perform the necessary steps to develop a non-ad valorem special
assessment rate for Fire Services and the development of an implementation plan.
The City Manager informed that the Property Appraiser has indicated the assessed values in the
City have grown; therefore, depending on the outcome of the budget hearings in August and the
approved millage rate, a study may not be necessary because the City may not need the fire
assessment.
Mr. Campbell moved to delay the study of the Fire Assessment and bring back at a time to
be recommended by the City Manager. Dr. Pullen seconded motion.
Mr. Tucker expressed his feeling that the City should move forward with the study because it is an
innovative way to provide the citizens with more safety and reducing the ad valorem taxes.
The City Manager advised that if Council votes to delay the study, it will not impact what has been
done thus far from a budget standpoint. She stated the plan is to have the additional paramedics _
and vehicle by April 1, 2006, and voting to delay action on the study would not jeopardize this.
The City Manager advised this issue can be brought back at a later date if necessary.
The Mayor called for the vote on the motion and it carried by a vote of 6 to 1 with Holmes,
Patterson, Campbell, Pullen, Hartwell, and Minich in favor and Tucker opposed.
RES. 05-14, PROCEDURES FOR AGENDA ACTION ITEMS
The Mayor read the resolution by title only.
A RESOLUTION OF THE CITY OF FORT WALTON BEACH, FLORIDA; PROVIDING FOR
AUTHORITY, MAKING FINDINGS OF FACT; ESTABLISHING PROCEDURES FOR AGENDA
ACTION ITEM REQUESTS FOR CITY COUNCIL AND ANY CITY BOARD, COMMISSION,
AGENCY OR COMMITTEE AND SETTING AN EFFECTIVE DATE.
The City Attorney advised the intent of the resolution is to make Board members, as well as Staff,
aware of the issues coming before them, and to enable time for Staff to respond to the request.
Discussion ensued regarding the submittal of an item 14 days prior to the date the agenda for
Council or any City board or committee is distributed. The City Attorney explained that date was
chosen because of the timing of distribution of the agendas to the Council as well as the boards.
However, she informed that any time between 10-14 days would be adequate. The City Attorney
noted this is not a legal issue; but rather one of policy.
The City Manager clarified she would continue to receive Council agenda requests as she has in
the past; this will not supersede anything in the Charter that directs Council to deal with the City
Manager, since Council cannot task Staff directly.
Mr. Minich moved to adopt Res. 05-14. Mr. Holmes seconded motion.

RES. 05-14 cont.
Council expressed concern that the resolution would restrict their ability to get an item on the
agenda. The City Manager advised she has always worked with Council on getting their requests
on the agenda, and she will continue to do so. She explained the resolution is to give Staff
enough time to research a complicated issue.
The Mayor called for the vote on the motion and it carried unanimously with Holmes,
Patterson, Campbell, Tucker, Pullen, Hartwell, and Minich in favor.
FLOC CITIES EXCELLENCE AWARDS PROGRAM
The City Manager explained the Florida Cities of Excellence Award Program, and noted that last
year the City sent in nominations for Mayor of the Year and Employee of the Year. She asked that
if Council had thoughts or recommendations for those or any of the other awards to let her know
and the resolutions will be done and brought back to Council in August.
The City Manager recommended Council consider Helen Spencer for FLOC City Clerk of the Year,
and Nancy McDonald, the City’s 2004 Employee of the Year, for the FLOC Employee of the Year
Award.
Discussion ensued and consensus of Council was to prepare resolutions for the following FLOC
Awards Program: Florida City of Excellence Award; City Spirit Award; City Clerk of the Year
Award; City Manager of the Year Award; City Financial Officer of the Year Award; City Employee
of the Year Award; and Citizen of the Year Award (Charlene Greenwald).
MPB APPOINTMENT
Consideration of appointment to the Municipal Planning Board.
Mr. Minich moved to appoint Charles Scott, 205 Beachview Drive, Fort Walton Beach, to the
Municipal Planning Board for a four-year term until June 13, 2009. Mr. Tucker seconded
motion and it carried unanimously with Holmes, Patterson, Campbell, Tucker, Pullen,
Hartwell, and Minich in favor.
MAYOR/COUNCIL ANNOUNCEMENTS
Mr. Hartwell wanted to clarify his article that was published in the Daily News regarding the vote on
the Sunrise on the Sound issue, and that he was not upset at the vote and that he felt comfortable
his fellow councilmen were doing the right thing.
Dr. Pullen discussed his personal position and responsibility as a member of Council; the
importance of legal counsel and her advice to Staff and Council; and his concern regarding the 75-
foot work in progress and the fact the Sunrise on the Sound development was presented to the
CRA and Council.
Mr. Tucker thanked First City Bank for presenting scholarships to two Emerald Coast students;
and noted that the City’s ad valorem taxes are over a billion dollars.
Mr. Campbell thanked the Staff and the Mayor for the Billy Bowlegs Festival and thanked the
Krewe for a great job at the parade; and thanked Jay Odom for his donation to the City’s fireworks
celebration.
Mr. Holmes also commented on the positive direction the Bowlegs festival took.
.Mayor Anderson announced several letters were received about the positive direction of the
Bowlegs parade and festival; and that he had a meeting with CDS staff, the TDC, and the
Chamber and they are working on a housing initiative.
