DIRECT SALE AGREEMENT—FAIRGROUNDS PROPERTY
Consideration of a direct sale agreement with the United States of America, acting by and through
the Forest Service, U.S. Department of Agriculture, for the purchase of a tract of land with
improvements, described as Tract A-943 (Okaloosa County Fairgrounds) and Tract A-944 (City
Ball Park), totaling 42.57 acres more or less, located in Okaloosa County at the approved
appraised value of four million dollars ($4,000,000) as outlined in the backup report. If approved,
staff will develop a financing planning utilizing bond proceeds and/or fund balance.
The City Manager explained a contract for the purchase of the fairgrounds property is before
Council for the cost of $4,000,000, according to the appraisal set by the US Forest Service. She
advised the City is talking with the Florida League of Cities (FLOC) about a possible 10-year
financing plan for the property at a rate of 3.87%. The City Manager further advised that funds
are set aside in the fund balance, of which a portion could be used, and that if it was Council's
desire, a combination of cash and financing could be used for the purchase. She informed if
Council authorizes the agreement, a survey of the property will have to be done at the City’s
expense.
Kyle Jones, Lands Program Manager with the US Forest Service, thanked the City for their
patience in working with the government, and stated with the finalization of this sale, the public will
be served. Mr. Jones advised the Forest Service is looking forward to working to expedite the
transferring of title of the property to the City. In response to the question of whether there would
be any stipulations or restrictions on what the City can do with the property, Mr. Jones explained
as a result of a letter from Eglin concerning future use restrictions on the property, there are two
restrictions. One restriction is a structure height limitation of 50 feet and the other restriction is to
require the approval of the Eglin Spectrum Management Office on the installation and/or use of
any electromagnetic radiation devices. He said other than that, once the City takes title they are
free and clear to do what they wish with the property. Mr. Jones confirmed he would provide to the
City a copy of the letter from the Eglin Encroachment Committee that addressed those restrictions.
Mr. Tucker moved to authorize the Mayor to execute, as soon as possible, the necessary
documents to acquire the property described as Tract A-943 (Okaloosa County
Fairgrounds) and Tract A-944 (City Ball Park), totaling 42.57 acres, more or less, located in
Okaloosa County, at the approved appraised value of four million dollars ($4,000,000) from
the Forest Service, U.S. Department of Agriculture. Mr. Campbell seconded motion.
Discussion ensued regarding the financing, and the City Manager clarified a variety of options are
available for funding the purchase of the property, which will be presented to Council in August.
The Mayor called for the vote on the motion and it carried unanimously with Holmes,
Patterson, Campbell, Tucker, Pullen, Hartwell, and Minich in favor.
