E. 1st 2nd ORDINANCE 1741 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA; PROVIDING FOR AUTHORITY; PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR THE REZONING OF 101 CHICAGO AVENUE SE MORE PARTICULARLY DESCRIBED IN THE BODY OF THE ORDINANCE, FROM R- NC RESIDENTIAL NEIGHBORHOOD COMMERCIAL DISTRICT TO R-2 MULTIFAMILY DWELLING DISTRICT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. The authority for enactment of this ordinance is pursuant to Section 2 of the City Charter of the City of Fort Walton Beach, and Section 166. 021( 1), Florida Statutes. SECTION 2. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach finds the following: A. That the Future Land Use Map of the Comprehensive Plan of the City of Fort Walton Beach designates the subject area as MDR Medium Density Residential; and B. That the subject area is comprised of approximately 0. 37 acres of land area; and C. The Municipal Planning Board held a public hearing and recommended the approval of the rezoning of the subject area from R- NC Residential Neighborhood Commercial District to R-2 Multifamily Dwelling District; and D. Public hearings have been conducted after giving due public notice pursuant to Section 166. 041, Florida Statutes, by the City Council of Fort Walton Beach; and E. That the zoning is consistent with the present Comprehensive Plan, adopted August 22, 2000. SECTION 3. PROPERTY REZONED. The following described property is hereby zoned R- 2 Multifamily Dwelling District: Lots 250 and 251, inclusive and the West one- half of vacated alley adjacent. Ocean City Subdivision, as recorded in Plat Book 2, Pages 28 and 28- A, of the Public Records of Okaloosa County, Florida. SECTION 4. ZONING MAP AMENDMENT. The Official Zoning Map of the City of Fort Walton Beach, as adopted by Section 12.40. 06 of the Land Development Code, is hereby be amended to include a change of classification from R- NC Residential Neighborhood Commercial District to R- 2 Multifamily Dwelling District for the specific area described in Section 3 of this Ordinance. SECTION 5. CONFLICTING PROVISIONS.
