participation as a routine part of the public hearing process. Previous efforts to improve public participation in statute have failed because they imposed excessive costs upon taxpayers or imposed unacceptable procedural delays to applicants. It should be noted that many cities throughout Florida already require some kind of citizen participation process in their land development codes. The League proposal is not being offered to interfere with those existing processes but instead to introduce a statutory minimum for everyone. Existing public participation ordinances are grandfathered. Amendment 4 applies only to plan amendments. This proposal applies to development orders as well as plan amendments because development order decisions ( such as a rezoning or a variance) almost always have a more direct and immediate impact on people and property than plan amendments. This proposal would send a strong message that Florida' s cities and the Legislature understand the current system is not working and that the status quo is unacceptable. It will allow local and state leaders to offer a reasonable alternative to the more radical constitutional and charter proposals being promoted by some. It will reaffirm local and state leaders' recognition of the importance of public participation in our state' s growth management processes. By putting this in statute these minimum standards become the " law of the land ". Everyone in the state would be at least entitled to these minimum, up -front opportunities to engage.
