Shalimar, FL 32579 Subject: Request for Vacation of Right-of-Way, County Resolution 09-76 dtd 17 March 2009 Dear Commissioner Ketchel, As I'm sure you are aware, the Not For Profit (see Attachment 5), all-volunteer Friends of the Shalimar Library will lose its current lease to the property at 6 10" Avenue, Shalimar, FL effective October 2016. This community library, supported financially by its Thrift Shop, $15 annual family memberships, and donations, has served the residents of Shalimar and other areas for the past-20 years. It is important to note that no tax dollars of any type have been used to support this library. The Board of Directors of the Library, our approximately 50 volunteers, and our many community family members feel it Is important to continue having a community library in Shalimar Due to the impending loss of our lease, we have very recently purchased vacant property at the corner of 8™ Street and 5™ Avenue (Port Dixie Block 52, Lots 4 and 5) as depicted in attached drawings/plat maps. In order to bulld our new library and thrift shop on this property, it is imperative that a portion of the County rights-of-way be vacated to meet County Land Development Code criteria for on-sight parking, building setbacks, fencing, and stormwater management. We are thus requesting that the Okaloosa County Board of Commissioners approve this request for vacation of right- of-way as scon as possible so that we can proceed with development to be ready to relocate prior to expiration of our lease. Request granting of this right-of-way vacation without stipulations other than utility easements. Further request that the Board waive the fees of $345 (1/2 of total fees in Attachment 1) as pald by the Friends of the Shalimar Library, Inc. We respectfully request that the Board of County Commissioners (BCC) agenda our request for the Public Hearing at the BCC meeting on January 5, 2016 at 8;30AM in Crestview, and that the Public Hearing be set for the BCC meeting on January 19, 2016 at 6:30PM in Shalimar. Expediting this action is needed to mest development criteria in order to relocate prior to our lease expiration date. The Shalimar Library Is being joined in this request by the owner of the adjoining propertles (Port Dixie Block 52, Lots 1 & 2, 3, and 6), David A. Parisot, who is a member of our Library Board of Directors. Vacation of the rights-of-way in front of Mr. Parisot's properties on 8" Street and 5™ Avenue will allow him to deed a portion of his . properties to the Friends of the Shalimar Library to provide additional land area to meet the criteria of the Land Development Code. Attachment 5 is a copy of the Not For Profit Corporation registration of Friends of the Shalimar Library with the FIorIga Dept of State, division of Corporations.
