John Hofstad, Utilities Director, advised that prior to converting the existing dry property known as Vesta lake to a stormwater holding pond, several issues must be addressed including permitting requirements; adjoining property owner concurrence; pedestrian access, and nuisance pests, to name a few. Mr. Hofstad explained that Staff contacted FDEP regarding the permitting process, and advised there is no guarantee from the FEDP that a permit will be granted for the proposed use. He also advised there is a stormwater holding pond to the south at the end of lake Drive, as well as a large stormwater retention facility on Wright Parkway. He stated that while it is possible to construct a stormwater holding pond at the Vesta lake property, the City should consider the impact of the issues, and that Staff feels it would not be in the best interest of the City. Dr. Pullen, who initiated the request, thanked Staff for the time and effort and the information that was provided to Council. Mr. Minich moved that the City convert the 4. 0 acres in the Vesta Heights Subdivision as a conservation buffer. Motion died for lack of a second. Mark Wiltsie, Human Resource Director, discussed two recruitment alternatives for the position of Finance Director. Alternative # 1 consists of a Review Committee appointed by the City Council to review applications and prepare a short list of 5 to 7 applicants to interview. Following interviews by the Committee, the list of finalists would be narrowed down to between 3 and 5 candidates and forwarded to Council for final interview and selection. Mr. Wiltsie explained this method was utilized successfully in the past with the Review Committee consisting of the City Manager, Human Resource Director and MIS Director. Alternative #2 would include providing the Mayor and City Council with a copy of all applications and resumes and summary of qualifications, then have Council meet and short list the candidates and schedule interviews. After the interviews, background investigations, reference checks and credit checks would be conducted, with an item placed on a City Council agenda to consider appointment. Council was advised the MIS Director was included in the last Review Committee because of the close ties between the MIS Department and the Finance Department in regards to the computerized functions of the Finance Department. Upon questioning, the City Attorney informed that the Review Committee is simply reviewing the applications and all will be submitted to Council, and that Council can still select a candidate who is not on the Review Committee' s short list. She further advised the Review Committee would be subject to the Sunshine Law due to the position being appointed. The City Manager stated there are many communities throughout the state that u se selection committees to assist Council in making decisions for their charter officers, but the final decision still lies with the City Council. Mr. Tucker moved to utilize alternative #1 for the recruitment process for the Finance Director. Mr. Campbell seconded motion and it carried unanimously with Holmes, Patterson, Campbell, Tucker, Pullen, Hartwell, and Minich in favor. The selection of a Review Committee will be proposed on the next City Council agenda. TERMS OF OFFICE FOR CHAlRNICE-CHAlR Consideration of a request to direct City Attorney to draft an ordinance that will enable each board and committee to establish terms of office for their chair and vice- chairperson. Dr. Pullen moved that each City board/committee establish for their respective group the terms of office for their chair and vice chairperson. Mr. Tucker seconded motion. Discussion included the importance of the boards and committees to assist in the running of the City; the role of the chairman to facilitate their respective board or committee; the restriction that could occur in City boards if the same individual is chairman every year; and that members of the boards and committees are aware of respective members time and personalities. Jim Dowling, 111 Ferry Road, stated it is possible the citizenry can be restricted if the same individuals are constantly elected to the position of chairman, as was the case several years ago and that is why the rules were changed. The Mayor called for the vote on the motion and it carried by a vote of 4 to 3 with Patterson, Tucker, Pullen, and Hartwell in favor and Holmes, Campbell, and Minich opposed. 0'_' _.. .____ _. ___~.__. -. - -.-------.--- 33 o o 11/08/ 05 TERMS OF OFFICE FOR CHAlRNICE-CHAlR ( CONTI Dr. Pullen moved to direct the City Attorney to draft an ordinance that will enable each board and committee to establish terms of office for their chair and vice chairperson and bring it back to the next Council meeting.
