BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: November 17, 2015 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Public hearing to vacate a portion of Marler Dr. on Santa Rosa Island DEPARTMENT: Public Works BCC DISTRICT: 2 STATEMENT OF ISSUE: Mr. Shaul Zislin of FWGV, LLC, represented by Preble-Rish, Inc., requested a Public Hearing to vacate a portion of Marler Drive located on Santa Rosa (Okaloosa) Island. To accomplish the vacation, the attached agreement provides a 60 day due diligence period for the developer to pursue all necessary permits, licenses, and exceptions. If the developer chooses to move forward, they will notify the County that they desire to proceed with the Petition to Vacate. If the developer does not move forward, the agreement will be null and void. BACKGROUND: The Santa Rosa Island Subdivision was platted and accepted by the Board of County Commissioners on April 12, 1958. Mr. Shaul Zislin of FWGV, LLC, desires to construct a restaurant with the potential for additional future development on a single parcel by combining several lots and vacated right-of-way. The agreement requires the petitioner to pay $110,000.00 to Okaloosa County and to construct a public boardwalk along the north side of the property that will connect to Marler Park at no expense to the County in exchange for the vacated right of way. The vacation request includes a release, by Okaloosa County, of the right-of-way conditions and stipulations as would otherwise apply to vacated property. The vacated right-of-way could then be built upon and utilized as additional property owned by the petitioner for purposes of density calculations and floor area ratio. The petitioner has granted the Okaloosa County Water and Sewer Department a utility easement to accommodate the Petitioner's proposed use of the property. Relocation of existing utilities would be performed by the developer at no expense to the County and coordinated through a subsequent development submittal review. OPTIONS: Approve/Disapprove RECOMMENDATIONS: Approve the agreement after the Public Hearing is held as scheduled by the Board for this meeting on November 17, 2015.
