MEMORANDUM
DAlE: ovenrrber13, 2006
TO: Joyce Shanahan, City Manager
FROM: Jeff Peters, Parks & Recreation Director
SUBJECT: Gibson Property Easement Agreement for Library Access
BACKGROUND
The existing city parking lot on Ferry Road to the east of the
library provides additional
parking for library patrons and library staff personnel. Staff contacted Mark Gibson, Vice
President of Gibson Properties, Inc., for his consideration to
grant the City an easement to
accommodate the service of a public walkway through their
property. The lighted walkway
will provide the public an accessible route from the
public parking lot on Ferry Road to the
Library.
DISCUSSION
The proposed 6' wide walkway will be constructed with
aggregate limestone materials as the
Owner may seek to improve and
develop the property in the future. If the Agreement is
approved by both parties, staff plans to install directional lighting from the Library site to the
walkway. Should the easement be canceled by the Gibson' s, the directional lighting will be
adjusted to the library property. If approved, funds for construction are available in
account # 001- 1000- 572-4650 Grounds Maintenance.
Please find attached a proposed Agreement between Gibson
Properties, Inc., and the City of
Fort Walton Beach which includes the
following features:
1) The term of the Agreement shall be a
running covenant and may be rescinded or
cancelled upon written consent of either party.
2) A variety of other
provisions to address indemnification, maintenance and the like have
been included in the proposed Agreement.
The City Attorney has approved the
Agreement as to form & legal sufficiency.
RECOMMENDATION
Staff recommends the City Council authorize the
City Manager to execute the Agreement
between Gibson Properties, Inc., John M. Gibson, Vice- President and the
City of Fort
Walton Beach, to grant the City an easement for a
public walkway across
