BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: December 16, 2014 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: 380558-BCC-2014: Request for rezoning, Velez - Castillo DEPARTMENT: Growth Management BCC DISTRICT: District 4 - Goodwin PUBLIC HEARING: Consideration of a request changing the use of land submitted by Samuel Velez-Castillo relating to property located at 670 Navy Street, Ft. Walton Beach. The request is to rezone the property from Residential - 2 (R-2) district to Manufactured/ Mobile Home Park (MHP) district, consistent with the future land use designation of Medium Density Residential (MDR). Property contains .44 acres, more or less. STAFF FINDINGS: • The subject property is located within the Medium Density Residential (MDR) future land use category. • The MHP zoning district is intended to implement the MDR future land use category. • The requirements for the MHP zoning district are expressed at Section 2.06.00 of the Land Development Code (LDC). • Subsection 2.06.01, LDC sets forth the purpose of the MHP district as: The purpose of the Manufactured/Mobile Home Park (MHP) district is to provide areas for the location of manufactured and mobile homes where spaces are rented for the placement, parking or accommodation of five (5) or more homes. • The purpose expressed above is taken from the definition found at Subsection 513.01, Fla. Stat. which reads: “Mobile home park” means a place set aside and offered by a person, for either direct or indirect remuneration of the owner, lessor, or operator of such place, for the parking, accommodation, or rental of five or more mobile homes. • Subsection 2.06.07, LDC sets forth bulk regulations for the MHP district as: Regulations controlling MHP districts shall be the same as those prescribed at Chapter 64E-15, Florida Administrative Code. • Rule 64E-15.002, FAC sets forth the minimum requirements for mobile home park spaces as follows. (2) Mobile Home and Lodging Parks. The minimum area requirements of each mobile home space constructed or developed after the effective date of this rule shall be as follows: (a) Each mobile home space designated for a single section mobile home shall contain a minimum of 2400 square feet with a minimum 35 foot width. (b) Spaces to be utilized for a double-wide mobile home shall contain no less than 3500 square feet with a minimum 50 foot width. (c) All mobile home and lodging park spaces and their appurtenances shall be located a minimum of 5 feet or more from the exterior boundaries, from the water of any canal, lake, or other body of water within the park. Rulemaking Authority 381.0011(13), 513.05 FS. Law Implemented 513.03 FS. History-New 5-20-96, Formerly 10D-26.110, Amended 12-30-09. • Staff has determined that the site will accommodate 5 mobile home spaces with the minimum 35 foot width and 2400 square feet required for a single section mobile home. • Comprehensive Plan Future Land Use Element Policy 4.4 requires consideration of compatibility as follows: Compatibility of adjacent zoning districts shall be considered during rezoning and land use plan amendments, considering potential maximum densities, intensities, and consistency of the potential land uses with surrounding districts, and the manner in which the land uses on the FLUM and the zoning districts result in an appropriate transition of uses, densities, and intensities (also see Policy 10.13). • Policy 10.13 states as follows: It is the intent of the County that the application of zoning districts for the implementation of the land use categories in this comprehensive plan provide for transition from more intense development to less intense development. Transition means that there is a gradual decrease in the allowable densities and intensities from one district to the next, with the most intense districts near municipal boundaries or areas of established intense urban development. The consideration of the degree to which the zoning districts accomplish transition between land uses shall be part of the review process for land use plan amendments and changes to zoning. PUBLIC COMMENT/OPPOSITION: None to date. PLANNING COMMISSION: The Planning Commission voted unanimously to recommend approval at a public hearing held November 13, 2014. MILITARY REPRESENTATIVE: No comment. STAFF POSITION: Staff has no objection to the requested rezoning. RECOMMENDATION: It is recommended that the Board consider the facts presented herein, the Planning Commission recommendation, as well as any facts that may be presented at the public hearing, and then decide whether or not to adopt the requested rezoning by ordinance RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
