PUBLIC WORKS SPECIAL EVENT PERMIT REQUEST BY RELEVENT ON
BEHALF OF V S PINK
Mr. John Hofstad, Public Works Director, stated a request for a
special event permit has been made by Relevent on behalf of V S
(Victoria Secret) Pink to hold a promotional event on March 13,
2014 from noon until 5:00 p.m. at James Lee Park. Proposed
activities include a cooling lounge, juice bar, games, and a DJ.
He advised the request has been vetted through all departments
and copies of the insurance have been received. Mr. Hofstad
said staff requests approval of the permit with the caveat
outlined by Undersheriff Adams at the beginning of the meeting
and with the applicant paying for the cost of additional law
enforcement. Mr. Amunds made motion, seconded by Mr. Pari sot,
to approve the special event permit request with the stipulation
the applicant hire additional off - duty officers for security at
a cost of $348. 5 yeas.
PUBLIC WORKS - MUNICIPAL SERVICES BENEFIT UNIT POLICY REVISIONS
Mr. Hofstad stated there has been a Municipal Services Benefit
Unit/Municipal Services Taxing Unit (MSBU/MSTU) Policy in effect
for several years. Existing MSBUs are for landscaping,
sidewalks, and street lights. He reported there have been
requests from residents in the Baker area to have road
construction accomplished through a MSBU. Mr. Hofstad said in
this specific instance there is no platted right - of - way and the
county has no right to be on the property. He clarified that it
is a two - rut private road. He stated the residents approached
Mr. Boyles last year about road improvements funded through a
MSBU. He informed the Board there was no mechanism in the
current policy to allow this request.
Mr. Hofstad advised the Board the MSBU policy has been revised
and vetted through staff. He acknowledged the input from Mr.

Boyles, adding Mr. Dowd also vetted the revisions. Mr. Hofstad
stated the revised MSBU Policy provides a mechanism for
unplatted property, through gathered efforts buying into the
process, to have funding for making certain improvements. He
stressed this policy is a "living document." The proposed
revisions do allow for a petitioning process with property
owners paying for the materials and using in - house resources to
construct roadways. He said that is the basic addition to the
policy.
Mr. Boyles thanked staff, saying he thinks this is an innovative
approach. He added that he believes this is a step in the right
direction. Mr. Boyles said the revisions include an extensive
petition process, conveying right - of-way, and buying the
materials.
Upon inquiry by Mr. Amunds, Mr. Hofstad stated the property
owners would have to deed the right - of - way before any money goes
into the MSBU. He added the policy outlines the timeframe for
the process, pointing out the MSBU will come back before the
Board for approval during an advertised public hearing.
Mr. Harris commended Mr. Boyles for pushing this through. He
also issued a challenge to the residents in The Pines
Subdivision to make use of the policy for their benefit.
Mr. Pari sot stated he likes the concept and giving people an
opportunity to help themselves . He said the policy could be
extended to creation of MSBUs for construction of sidewalks and
stormwater systems. Mr. Pari sot stated there are some changes
that need to be made to the proposed policy and he would rather
those changes be inserted and brought back at the next meeting.
Mr. Parisot made motion to make updates to the proposed policy
and bring it back at the next meeting. Motion dies for lack of
a second.
Mr . Boyles asked the nature of the updates. Mr. Parisot replied
some are legal "things" which should be addressed with Mr. Dowd.
He said the policy should be expanded to other areas. Mr.
Parisot said the language says right - of - way "must be deeded" but
that would not work for stormwater across someone's property and
would need to be an easement.
Mr. Boyles stated the proposed revision policy is geared with
some changes for MSBUs in general and others are specifically

for road construction. He said there is one policy for street
lighting and one for road construction. Mr. Boyles recommended
Mr. Parisot work with staff to create a third policy relating to
stormwater and a fourth for sidewalks. He underscored the fact
that the policies for each type of MSBU will vary.
Continuing, Mr. Boyles stated he has no problem with correcting
any technical difficulties.
