CBA staff is requesting renewal of the agreement for the third annual term of the four year proposal. Council previously approved funding for this service in the FY 07/ 08 Budget. Staff believes the CBA has honored all of the terms of the agreement during the past year and that the continued partnership with the CBA is beneficial in meeting the goals and objectives of the City's Stormwater Management Plan. The NPDES agreement was approved by City Council on Tuesday February 12, 2007 and renewable for two years, if approved by Council, beginning February 143k 2008. Furthermore, the initial NPDES agreement was reviewed by the City Attorney and approved as to form and legal sufficiency. A copy of the City Attorney's concurrence is attached to this report for review. Recommendation: Staff requests Council authorization for the City Manager to execute the renewal agreement with the Choctawhatchee Basin Alliance for services not to exceed $ 51500 annually related to ongoing implementation of the National Pollutant Discharge Elimination System Phase II program regulated by the Florida Department of Environmental Protection.
