BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: December 17, 2013
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Public Hearing - Vacate a Portion of Alley in Blk 7 Bay View Subdivision
DEPARTMENT: Public Works
BCC DISTRICT: District 2
STATEMENT OF ISSUE: Mark Siner, P. E., Choctaw Engineering, Inc. On behalf of Fortune
900 LLC, is petitioning the Board of County Commissioners to vacate a portion of the North-
South alleyway through Block 7 of the Bay View Subdivision in the Ocean City Area.
BACKGROUND: At the Board's regular meeting on November 19, 2013 the request for the
vacation was heard. Concerns from residents in the neighborhood were raised regarding access
to the rear of the parcels along the alley and potential violations of items within the alley in the
subject location.
The request made by Fortune 900, LLC is for the Board to vacate the public's interest in the
northern 150' of the 20' alley in Block 7 of the Bay View Subdivision. The alley is unopened
and not maintained by Okaloosa County. If approved, Fortune 900, LLC will receive the full
width (20') of the alley since they own both of the adjoining parcels. The vacation is being
requested without stipulations except that which reserves a full width utility easement for all
licensed utility companies including a stormwater/drainage easement for the County.
Following up on input from the prior meeting, staff has determined that a travel trailer is parked
within the alley and has approved connections to potable water and sewer services. The
applicant has stated (by way of written correspondence attached) that the trailer within the alley
is to remain vacant until final action has been taken by the Board; at that time it shall be utilized
for security purposes. Should the vacation request be denied the applicant will be required to
removed the travel trailers or be subject to code enforcement actions.
Public Works' staff has also discussed the request to remove certain stipulations with utility
providers and a specific request from the Water and Sewer Department was made. Because there
are existing water meters and sewer access points, not only will the utility/stormwater easement
need to remain in effect should the vacation be approved, but Water and Sewer requests that they
be allowed to gain access to the meters for periodic reading and maintenance. If a fence were to
be erected, access privileges would have to be coordinated with the water and sewer department.
No other utility has expressed any objections at this time.
OPTIONS: Approve/Disapprove the vacation of the northern 150' of the 20' alley in Block 7 of
the Bay View Subdivision in the Ocean City area with the stipulation that a utility/drainage
easement be retained and access to the easement be granted to water and sewer for periodic
meter reading and maintenance.
RECOMMENDATIONS: Approve the vacation of the northern 150' of the 20' alley in Block 7
of the Bay View Subdivision in the Ocean City area with the stipulation that a utility/drainage
easement be retained and access to the easement be granted to water and sewer for periodic
meter reading and maintenance.
