BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: September 15, 2015 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Modification 11 to FDEO NSP Agreement and Amendment No. 8 to OCDC NSP Contract DEPARTMENT: Growth Management BCC DISTRICT: All STATEMENT OF ISSUE: Staff requests the Board: 1.) approve the attached Modification Number 11 to the Neighborhood Stabilization Program (NSP) Agreement, Contract Number 10DB-4X-01-56-01-F18, between the Florida Department of Economic Opportunity (FDEO) and Okaloosa County BCC which will extend the contract end date to March 31, 2016 and amend pages 1-13 of the Agreement along with Attachments H and I; and 2) approve the attached Amendment No. 8 to the County’s contract (C10-1798-GM) with the Okaloosa Community Development Corporation pertaining to the Neighborhood Stabilization Program. This amendment will extend the expiration date to March 30, 2016, matching the County’s contract (10DB-4X-01-56-01-F 18) with the State of Florida Department of Economic Opportunity (DEO). It also will incorporate Modification No. 11 to the County’s contract with the State of Florida DEO. BACKGROUND: Okaloosa County was allocated $2,255,252 for the regular State NSP allocation, and an additional $1,003,183 for the NSP supplemental allocation for rental housing. The Agreement governing the expenditure of these funds (10DB-4X-01-56-01-F18) was executed between the BCC and the FDEO on November 24, 2009. Since that time the FDEO made an additional award to Okaloosa County in the amount of $715,111.77, which included an award amount of $301,917.73 and $413,194.04 of program income. On April 20, 2010, Okaloosa County entered into a Contract (C10-1798-GM) with the Okaloosa Community Development Corporation (OCDC) whereby the OCDC would administer the NSP program. Since that time, the OCDC has purchased numerous properties for use as affordable housing pursuant, including the partially completed Palm Village project which serves both as affordable housing as well as a location for the construction of additional affordable housing units as funds allow. On July 2015 the Board approved the OCDC's hiring of Thomco Enterprises to serve as the general contractor to construct 6 new townhome units at the Palm Village development. Both the Agreement between the County and the FDEO and the contract between the County and the OCDC expire on September 30, 2015. Because the Contract between the County and the OCDC incorporates the FDEO Agreement, it is not possible to extend the contract until such time as the Agreement with FDEO is extended. Unfortunately, the County did not receive Modification 11 from the FDEO until after the BCC's September 1 meeting, so it is therefore necessary to approve the Modification and Contract as part of a single agenda item to ensure that the approvals occur in the correct sequence. Once Modification 11 to the FDEO Agreement is signed, it will be sent to the FDEO for signature. A fully executed copy will be returned to the County which will be attached to the OCDC Contract (C10-1798-GM). Until such time as the fully executed Modification is returned, a copy bearing only the BCC Chairman's signature will be with the OCDC Contract. RECOMMENDATION: Staff recommends the Board take the following actions in the order presented: 1. that the Board of County Commissioners approve and authorize the Chairman to sign Modification Number 11 and the associated transmittal letter to the FDEO for NSP Agreement Contract 10DB-4X-01- 56-01-F18, as well as any future extensions and other grant documents during the term of this NSP grant, and that the signed Modification and transmittal letter be sent to FDEO for that agency's signature; and. 2. that the Board of County Commissioners approve and authorize the Chairman to sign Amendment No. 8 to Contract Number C10-1798-GM, between Okaloosa County and the Okaloosa County Community Development Corporation for NSP administration as well as any future extensions and related documents associated with the OCDC's administration of this NSP grant, and 3. that the Board of County Commissioners authorize and direct that a copy of the Modification signed by the Chairman only be kept with Contract C10-1798-GM until such time as the fully executed Modification (bearing the signatures of both the Chairman and the FDEO's representative) is returned to the County, at which time the fully executed copy shall replace the copy bearing the Charman signature only.
