( Bull) Rigdon, Jr. CEO of the Northwest Florida Fair Association Beach clarification on the terms and conditions of the license agreement between the City of Fort Walton their and the Northwest Florida Fair Association with regard to Use and Conditions, Section 2 8., regarding submission of their 2006 Operations Plan and whether "like kind" activities are permitted without express written consent of City Council. 194 Regular Council Meeting 4/ 25/ 06 LICENSE AGREEMENT ( CONTI The City Manager advised she received a letter from Mr. Rigdon regarding the license agreement adopted on December 29, 2005. She explained that Mr. is Rigdon requesting that he be permitted to substitute or add "like kind" events to the events at the fairgrounds besides those already listed in the Operation Plan for 2006 that was presented to Council in January. Charles Rigdon, CEO of the Northwest Florida Fair Association, distributed a Revised Plan of Operation for 2006 for the fairgrounds. Mr. Rigdon explained that he is receiving requests from organizations to rent the fairgrounds for events that are not on the Operating List submitted in January; therefore, he must receive permission from Council for these events. He advised that sometimes the events come to him on short notice and there may not always be two weeks until the next Council meeting for these events to be approved. He requested that the license agreement be amended to allow the City Manager to approve like kind" activities that are not currently part of the Operations Plan. Mr. Rigdon emphasized that no event would even be considered if it were thought to be offensive to the city or its citizens, and that "like kind" activities would include tool shows and car/antiques shows. Council expressed concern that on the revised Operations Plan, events are listed that have occurred the past three months that were not on the original Plan submitted in January. Mr. Rigdon explained he was under the impression that he could add those like kind events without going before Council. Further discussion included that these type of issues should have been discussed during discussion of the terms of the agreement, and that Council can consider a request by Mr. Rigdon during the consent agenda if Mr. Rigdon forwards his request. Mr. Rigdon advised he has three organizations wanting to use the fairgrounds and cannot wait two weeks until the next Council meeting. Mr. Patterson moved to amend the License Agreement to state that no activity shall be permitted upon the Premises other than those activities/ events specifically authorized by the City Council in the Operations Plan, without the written consent of the City Manager. Dr. Pullen seconded motion. Mr. Patterson, the City' s representative on the Fair Board, stated his feeling that the Board members are working hard at laying out a plan to bring more business to the fair which would mean greater income for the City, and that during the next 12 months there should be an increase in the amount of income for the City from the fairgrounds, and the City should not be micro- managing the business of the fair. Further discussion included the fact that the lease has been in effect for only four months, and that it may have to be re-evaluated next year. The Mayor called for the vote on the motion to amend the license agreement to allow the City Manager to approve or disapprove activities held at the Fairgrounds and it failed by a vote of 3 to 4 with Patterson, Tucker, and Pullen in favor and Holmes, Campbell, Anderson, and Minich opposed ( Hartwell absent). Mr. Tucker advised he voted in error and he wants the agreement with the Fairgrounds to remain as it is. The Mayor called for the vote on the motion to amend the license agreement to allow the City Manager to approve or disapprove activities held at the Fairgrounds and it failed by a vote of 2 to 4 with Patterson and Pullen in favor and Holmes, Campbell, Tucker, and Minich opposed ( Hartwell absent). MAVOR/COUNCIL ANNOUNCEMENTS Dr. Pullen mentioned the possibility of a hostile work environment in City administration, and the legal ramifications if such a situation exists. He expressed a desire for the City Manager to investigate whether asituation is occurring in the City, and if so, take corrective action if necessary, and inform Council. Council suggested that specific allegations be brought to the City Manager' s attention for investigation. 195 Regular Council Meeting 4/ 25/ 06 MAYOR/COUNCIL ANNOUNCEMENTS ( CONTI Mr. Campbell thanked staff for their work on the boarding house on McGriff Street The City Manager also thanked staff for their hard word in coordinating the efforts securing the property and reported there are no tfI1I'" residents remaining. BANKING SERVICES RFP Mr. Campbell announced a conflict on the Banking Services RFP' s because he is a minor stockholder in a local bank. He has signed the conflict of interest form. He wished to state for the record he was not aware it was a conflict until it came to a vote and he would abstain at that time. The City Attorney advised Council needs to correct the action that was taken on the RFP on February 14th, and the correct motion would be to rescind that then the issue will be open again for Council. Mr. Holmes moved to rescind the action of Council taken February 14, 2006 on the motion to reject all the current proposals and direct staff to re-bld and exercise local preferences of our purchasing policies only. Mr. Minich seconded motion and it carried unanimously with Holmes, Patterson, Tucker, Pullen, and Minich in favor (Campbell abstained; Hartwell absent). The City Attorney advised that Council is back to square one on the RFP' s. She noted the item before Council on February 14th was to accept one of those proposals at that time and the action taken at this time is up to Council. The City Manager expressed her understanding that Council just rescinded the action to reject all bids and directed her to re- bid. She reported the bids were received today on the re- bid. She mentioned if it is still Council' s desire for local preference, to direct staff to continue with the bids currently received; but if Council wishes to expand the local preference to include any bank in the City, she suggested Council direct her to talk with the banks that bid the first time to determine their interest in bidding again with the second re-bid, which would involve extending the bid date by about 30 days. During discussion on which action to take regarding banking services, the City Manager pointed out that the bids received on the first RFP typically expire after a certain period of time. Mr. Holmes moved to continue the direction given on February 14, 2006 to reject all current proposals bid and exercise local preferences of our purchasing policies from the previous RFP) and direct staff to re- only. Mr. Tucker seconded motion. There was an exchange of views whether the RFP should include the restriction for local preferences or without the restriction. The City Manager explained that the bids received in February have expired, and those bids may need to be rejected. She further explained that during the process the RFP was improved with the second RFP
