that funding source. With regard to the revenue split, Mr,
Hofstad said it was originally 70/30 based on the first
evaluation on transportation costs. This resulted in a “brush
back” from cities and staff re-evaluated the transportation
costs and chose to back out enterprise funds. The result was a
64/36 split. Mr. Hofstad stated there is consensus from the
cities this is acceptable.
Mr. Rob English, Laurel Hill, posed questions on the maintenance
costs and the purchase of a crane. Mr. Hofstad explained the
fleet has decreased but cost of maintaining the older vehicles
has increased. With regard to the cranes, Mr. Hofstad stated
they are in use 197 working days a year.

Mr. English said he understands the need to build roads but
encouraged the Board to find money in the budget rather than
increasing taxes.
Mr. Wendell Batey asked the Board not to levy this gas tax.
However, if that decision is made, he asked the Board to
consider adjusting the ad valorem tax by the same amount as the
gas tax increase. Upon inquiry by Mr. Batey, Mr. Amunds replied
that Tourist Development tax money cannot be used for roads and
the request to the legislators was to use TDC taxes for
emergency personnel during the tourist season.
Mr. John Edwards, Crestview, stated if there is not proper
maintenance, the repair costs could be major. He said he has
four vehicles on the road and estimated the cost to be $7.00 per
week in additional gas tax money. Mr. Edwards stated the safety
issues are clear and no one likes running into a pothole.
Mrs. Betsy Roy, Crestview City Clerk, stated the city would like
to ask for the 64/36 split of the gas tax revenues. She said
because of revenue losses, the city has no paving projects in
the budget for the coming year. Mrs. Roy clarified the city
will lose $42,000 per year without passage of the additional
LOGT.
Mr. J. B. Whitton, Crestview, said per DOR the state average gas
tax is eight cents and listed the tax amount for many counties.
He remarked that Gulf Power Company is planning an increase in
rates, the City of Fort Walton Beach is raising its taxes,
Crestview is on the fence on raising taxes, and Destin may raise
taxes as well. Mr. Whitton stated all of this will have an
impact on senior citizens with a fixed income.
Mr. Amunds asked Mr. Whitton if his research also compared the
ad valorem tax rates and sales tax rates of Escambia, Walton,
and Santa Rosa Counties to Okaloosa County.
Mrs. Pat Hollarn, Shalimar, congratulated the Board for bringing
up this issue. She said it has been talked about and put off
over and over again. Mrs. Hollarn told of her experience
working with former Planning & Zoning Director Collier Houston
in the 1980s on stormwater management issues. She said those
plans were shelved because it seemed like a “T-A-X." Mrs.
Hollarn stated it will take courage to continue and many people
do understand the need. She encouraged the Board to support a
five-cent increase. Mrs. Hollarn also said she does not think

the TIF concept (tax increment financing) for North County
should be discarded.
Mr. Michael Barnes, Fort Walton Beach, President of the Okaloosa
Citizens Alliance (OCA) and citizen, stated he supports what the
commissioners are doing. He encouraged them to do what is best
for the county. Mr. Barnes said the Board has cut to the bone
and there is nothing else to cut.
Mr. Amunds brought the discussion back to the Board. Mr, Harris
said he has always considered gas tax a user fee. He opined if
you have a problem with it, don’t use as much gas. Mr. Harris
said approving three cents or five cents is just trying to catch
up and the only alternative is to continue to “kick the can down
the road.” He also stated that he is a big believer in the TIF
for North County. Mr. Harris pointed out stormwater issues are
becoming worse and if we don’t do something, we could he
compelled to act by the State.
Mr. Windes said he agrees with most everything Mrs. Hollarn
stated except he can only support a three-cent increase in the
gas tax. He referred to his campaign platform and said three
cents is as far as he can go.
Mr. Parisot said the problem with only three cents is that the
first few years it will be eaten up in operating costs and
purchasing needed equipment. He agreed with Mr. Harris this is
a user fee.
Mr. Boyles made motion, seconded by Mr. Harris, to adopt the
proposed ordinance for the second LOGT using the 64/36 revenue
split with the municipalities, and approving three cents rather
than five cents. 4 yeas, 1 nay. (Mr. Amunds voted no.)

Mr. Daniel O’Byrne, Tourist Development Department (TDD)
Director, asked the Board to accept public comments on the final
assessment resolution. He noted this is the same item which was
presented to the Board during public hearing on August 20, 2013.
Mr. Amunds opened the floor for public comments. No one came
forward to speak.
Mr. Parisot felt this issue should be brought to the Board in
the March/April 2014 timeframe to take a look at possibly doing
away with the assessment. He pointed out this action would need
to be coordinated with the lending agency.
Mr. Harris made motion, seconded by Mr. Boyles, to adopt the
Final Assessment Resolution for the Destin Subarea of the
Okaloosa County Beach Restoration MSBU. 5 yeas.
RESOLUTION NO. 13-122
PUBLIC HEARING - ORDINANCE AMENDING CHAPTER 12 OF LAND
DEVELOPMENT CODE
Mr. Stanford read the advertised legal notice for public hearing
to consider a request from the Growth Management Department to
amend the Land Development Code (Ordinance No. 90-01) by
revising Chapter 12 Fees and Fines, Section 12.02.00.
Mr. Elliot Kampert, Growth Management Director, termed this
request a matter of “housekeeping.” He said the Florida
Legislature adopted House Bill 269 during the regular 2013
session which amends Section 489.127(5)(c) and (f), Florida
Statutes, to increase the penalties for unlicensed contracting.
No one came forward to speak in favor of or in opposition to the
proposed amendment. Mr. Windes made motion, seconded by Mr.
Harris, to adopt the amendment to Chapter 12 as advertised.
5 yeas.
ORDINANCE NO. 13-23

7. Request approval of and authorize the Chairman to execute a
resolution in support of a deed transfer related to County
Surplus Property Sale
Mr. Parisot noted the proposed resolution refunds not only the
purchase price but the cost of a survey and recording costs and
asked for more details. Discussion ensued. Mr. Parisot made
motion to refund the purchase price. Upon inquiry by Mr.
Harris, Purchasing Director Richard Brannon stated the
advertisement for bid/sale of the surplus property contained the
provision the purchaser would be responsible for those costs.
Mr. Amunds said we found out we were negligent on this property
and he would feel better about splitting the costs of the survey
and recording the document.
Mr. John Hofstad, Public Works Director, stated the parcel was
advertised based on the description they had. He said the
county has only one survey crew and after discussions with the
County Administrator, it was decided the winning bidder would be
responsible for obtaining the survey. Mr. Hofstad reported when
the survey was conducted, it was discovered the description
included public streets and right-of-way. He said obviously the
county does not want to sell roads. Mr. Hofstad noted that not
having a survey is a fallacy in selling “surplus property.” Mr.
Brannon said in the future the county may need to require a
survey by a private firm on surplus properties and the cost of
that survey will bé included in the sale price. Mr. Hofstad
said we have several hundred parcels and he agrees with Mr.
Brannon about securing a survey in advance.
Mr. Parisot repeated his motion to reimburse the purchase price
but not the cost for the survey. Motion dies for lack of a
second.
Mr. Harris made motion to reimburse the purchase price and pay
half of the survey cost. Motion dies for lack of a second.
Mr. Dowd stated he prepared the resolution and he believes the
Board should reimburse the full cost.
Mr. Harris made motion, seconded by Mr. Windes, to approve
reimbursement to Crestview Property Services for the purchase
price of the property, survey, and recording costs upon receipt
of a fully executed deed returning the subject parcel to the

RESOLUTION NO. 13-123
Mr. Parisot requested discussion on Item #10 regarding a budget
transfer in the Airports Enterprise Fund (BT-13-47). One of the
transfers was for $350,000 from Capital Outlay Reserves for a
cell phone waiting area at VPS. He suggested those funds be
used to enhance Bob Sikes Airport.
Mr. Sunil Harman, Airports Director, stated the proposed
transfer does not diminish the Foy Shaw Boulevard project. He
said these are VPS (Northwest Florida Regional Airport) funds
and will be used to provide a cell phone waiting area. This
area will be an improved roadway for about thirty cars waiting
for arriving passengers to call by cell phone to arrange
curbside pickup.
Mr. Parisot made motion to reallocate that $350,000 to Foy Shaw
Boulevard at Bob Sikes Airport. Motion dies for lack of a
second.
Mr. Boyles made motion, seconded by Mr. Windes, to approve Item
