Captain Windes,
I’m writing you this letter to petition the Board of County Commissioners for vacation of
a county right-of-way.
In 1968, Okaloosa County received a segment of property from Bill E. Boone & Reba
Boone, husband and wife, for the purposes of providing access to property at 502 Bullock Blvd,
where a new home had just been built. A roadway was put in, as well as a sewer line that serves
only 502 Bullock. Both the roadway and sewer line as installed encroach upon the property at
500 Bullock Blvd. In addition, at 42 feet in width, the land given to the county does not conform
to current county standards for Public right-of-way.
T am now the new owner of 502 Bullock Blvd, held under Okaloosa Walton Development
Company. I am developing this parcel and several others combined with it as a small
neighborhood of single family homes. This subdivision will have a private, HOA maintained
roadway and drainage systems.
A condition for development of the subdivision is that I am to tear out the current
roadway and sewer line, and re-install them within the proper boundaries. In addition, I must
provide civil engineering to accommodate the storm-water runoff from this small section of
roadway.
After conversation with staff of Okaloosa County, it appears that transferring this non-
conforming right of way to the new subdivision as a private roadway makes more sense, as it
primarily serves that property. The county standard for a private right-of-way is 40 feet. The only
odd issue associated with such a transfer is that ri ghts-of-way are typically vacated to property
owners along either side, as opposed to at the end of a road, Additionally, vacating the right-of-
way to anyone other than my company would actually landlock the parcel, which is not the
desired outcome. In order to address this, I have reached an understanding with the landowners
along either side of this right of way that they support this request for vacation of right of way,
and that they wish to see this vacated right-of-way become a private roadway to the new
subdivision.
In summary, this is a petition to vacate the current non-conforming right-of-way leading
to 502 Bullock Blvd and to transfer it to Okaloosa Walton Development Company for the
installation of a new sewer line and a new, non-encroaching private roadway leading to and part
of the proposed new private road subdivision.
I appreciate your time and consideration in this matter, and am available at any time to
further discuss or clarify any issues that may arise.
Thank you,
f
