The purpose of this modification is to affect NO-COST delivery date extensions for contractor work on CLINs 0003 through 0006, due to Government-caused delays. The changed work is addressed in the attached REVISED contractor Statement of Work (SOW), titled Eglin Wastewater Treatment Reconfiguration Phase IB & Phase II (Okaloosa County Water and Sewer). This Revised SOW is dated 25 Nov 2013, and amends/replaces the prior SOW (same title) dated 16 July 2012. Again, these are No-Cost (to the Government) changes due to Gov. delays. B. SUPPLEMENTAL AGREEMENT: The parties agree that this supplemental agreement establishes the consideration for modifications effected herein. The parties specifically acknowledge and agree that this supplemental agreement constitutes full satisfaction of the parties’ rights to equitable adjustment, under any clause of this contract, relating to the modifications effected herein. C. CLIN 0003 / Phase II work (Eglin Main Connection) was delayed due to unforeseen site conditions which caused the Government to request a new contractor routing alignment with a corresponding delayed change in design plans. Contractor requested an eight-month delivery extension to CLIN 0003, which the Government Program Manager has approved. The delivery date for CLIN 0004, Capacity Expansion Charges (Eglin Main) is tied to the completion of CLIN 0003, and must, therefore, be similarly extended to match the new CLIN 0003 delivery date via this modification. D. CLIN 0005 / Phase III work (Camp Rudder Connection), which was set to immediately follow the completion of CLIN 0003, is therefore correspondingly delayed for eight months as well. Contractor requested a similar eight- month delivery extension to CLIN 0005, which the Government Program Manager has approved. The delivery date for CLIN 0006, Capacity Expansion Charges (Camp Rudder) is tied to the completion of CLIN 0005, and must, therefore, be similarly extended to match the new CLIN 0005 delivery date via this modification. E. Contract total cost and funding remain unchanged. F.
