BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: December 3, 2013
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Submittal of Notice of Intent for National Pollutant Elimination System
Permit
DEPARTMENT: Public Works
BCC DISTRICT: All
STATEMENT OF ISSUE: The Notice of Intent (NOI) for the National Pollutant Discharge
Elimination System (NPDES) Phase II Municipal Separate Storm System Permit for Years 2015
- 2020 is due to be submitted to the Florida Department of Environmental Protection (FDEP) on
or before January 8, 2014. The annual report for our required Best Management Practices
(BMPs) for 2013 is also due January 8, 2013. Both will require the signature of the chairman for
submittal.
BACKGROUND & ANALYSIS: The NOI is a five-year permit which is administered and
regulated by FDEP. This permit is a requirement of a federal mandate, initially imposed by the
U.S. Environmental Protection Agency, that all local governments accept the responsibility of
the management of stormwater which enters the receiving waters of the State. The fee, which is
required for submittal of the NOI, is $11,700. The annual report which outlines our required
self-imposed BMPs is due for submittal in conjunction with the NOI. The annual report will also
require an on-site review which will be scheduled by FDEP at a date to be determined in the
summer of 2014. Previous reviews of our annual report and on-site reviews have resulted in
favorable responses from FDEP. Based on recent conversations with FDEP staff, Okaloosa
County Public Works does not have any outstanding compliance issues which should result in a
positive annual review in the coming year.
OPTIONS: Approve/Deny submittal of the NOI, the required $11,700 fee, and annual report for
the NDPES permit.
RECOMMENDATIONS: Staff requests Board approval to submit the NOI, authorization for
the required $11,700 permit fee, and approval to submit the annual report for the NDPES permit.
Contingent upon Board approval, staff requests authorization from the Board for the Chairman to
execute all associated documents.
