Lane previously sent us a letter indicating that the Fund underperformed the target index by more than 1, 000, 000. At the meeting they will present the preliminary damage assessment, discuss the status of the ongoing litigation project involving Merrill Lynch and Michael Callaway, and answer questions the Council may have concerning the matter. I have attached a Complaint in the Firefighter plan' s case against Merrill Lynch for your information. Please advise if you need additional information concerning the appearance at the meeting. In order to pursue this, Mr. Miller will need to present the facts, etc. to City Council. Our next meeting is January 12, 2010 at 6:00 pm. Because of the timeline stated in the correspondence, I assume he will want to make the presentation at this meeting. If so, I will need an outline of his presentation no later 34- 1/ 6/ 2010 than Wednesday, January 6, 2010. In addition to the presentation for the General Employees' Pension Plan, Mr. Miller should be prepared to address whether or not the Police and Fire pension boards are participating in the claim. Thanks in advance for passing this information along to Mr. Miller. Please let me know when you here from him. Brandy L.
