S., 1 RESOLUTION 2011 -10 2 3 4 A RESOLUTION OF THE CITY OF FORT WALTON BEACH, FLORIDA, 5 CERTIFYING THAT THE CITY MEETS THE FISCAL HARDSHIP CRITERIA OF 6 SECTION 218. 075 FLORIDA STATUTES, AND QUALIFIES FOR A REDUCTION 7 OR WAIVER OF PERMIT PROCESSING FEES FOR THE FLORIDA DEPARTMENT 8 OF ENVIRONMENTAL PROTECTION ( FDEP) AND /OR THE NORTHWEST 9 FLORIDA WATER MANAGEMENT DISTRICT (NWFWMD) FOR 2010/ 2011. 10 11 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT 12 WALTON BEACH, FLORIDA AS FOLLOWS: 13 14 Section 1. Authority & Intent 15 Pursuant to section 218. 075, Florida Statutes, the City may qualify for a reduction 16 or waiver of permit processing fees payable to the Florida Department of Environmental 17 Protection or the Northwest Florida Water Management District. To qualify for the 18 reduction or waiver of permit processing fees for the 2010 -11 fiscal year, the City must 19 certify that the cost of the permit processing fee is a fiscal hardship due to one of the 20 enumerated factors in section 218. 075, Florida Statutes. 21 22 Section 2. Certification 23 The cost of permit processing fees is a fiscal hardship for the City pursuant to 24 section 218. 075( 2), Florida Statutes Section 218. 075( 2), Florida Statutes, specifies that a 25 fiscal hardship may be proven if the " percentage of assessed property value that is 26 exempt from ad valorem taxation is higher than the statewide average for the current 27 fiscal year." The City certifies that the cost of permit processing fees is a fiscal hardship 28 because the percentage of assessed property value that is exempt from ad valorem 29 taxation is higher than the statewide average for the current fiscal year. The facts that 30 support that conclusion are that according to data from the Florida Department of 31 Revenue, Office of Property Tax Oversight (Jan 2011): 32 a. The total assessed value of ad valorem property statewide was $ 1, 781, 700, 000 33 ( x1, 000). 34 b. Of the above amount, exempt properties including homestead exemptions and 35 those classified as " other ", is $ 436, 610, 000 ( x1, 000). 36 c. Therefore, from the above data, the percentage of assessed property that is exempt 37 statewide is 24. 51 %. 38 d. The City of Fort Walton Beach had a total assessed value of ad valorem property 39 in 2010 of $1, 679, 673 ( x1, 000). 40 e. In 2010, the City' s total amount of exempt ad valorem properties was 41 $ 469, 933, 333. 42 f. The percentage of exempt properties in the City of Fort Walton Beach was 43 28. 00 %. 44 g. Fort Walton Beach' s 28. 00% of exempt properties exceeds the statewide average 45 of 24. 51% and therefore the City is eligible for a fiscal hardship exemption under 46 Criteria 2 above. 1 2 Section 3.
