BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: October 1, 2013 TO: Honorable Chairman and Members of the Board FROM: John Hofstad SUBJECT: Vacate a portion of alley in Block 53 Port Dixie DEPARTMENT: Public Works BCC DISTRICT: 2 STATEMENT OF ISSUE: Michael and Dawn McArdle are petitioning the Board of County Commissioners to vacate a portion of the East-West alleyway through Block 53 of the Port Dixie Subdivision in the Shalimar area. BACKGROUND: Portions of the alleyway (the east 120 feet) through Block 53 were previously vacated by Resolution 09-43. The McArdles' proposed vacation lies west of the previous vacated alleyway and measures 20' wide by 95' long. If approved, the McArdles would receive the north half of the vacated alleyway measuring 10' x 95'. (See attachments for clarification of the requested vacation.) A site visit revealed an encroachment into the unopened alleyway due to an existing building. It appears that an approval of the vacation by the Board would not solve the encroachment issue. (See attached photos of building and approximate encroachment.) All normal stipulations of vacated rights-of-way required by the County are requested to be waived. OPTIONS: Approve/Disapprove a request for a Public Hearing to vacate said right-of way. RECOMMENDATIONS: Approve the request for a Public Hearing to be scheduled on October 15, 2013 for the right-of-way vacation request from the McArdles. RECOMMENDED BY: APPROVED BY: Ernie Padgett, County Administrator
