Comment:
I would like to see the following changes made to the contract before signing:
I. Change Law and Venue section, page 8 to reflect that venue will lay in Okaloosa County,
Florida and not in Virginia.
2. Add under Indemnity section, page 9 to the following language:
SOVEREIGN IMMUNITY: Nothing in this agreement is intended to nor shall be construed to
waive the City of Fort Walton Beach' s right and immunities under the Florida Constitution,
Common Law, or Florida Statutes Sec. 768. 28, as amended from time to time.
They should not have a problem with the changes since these mirror changes we put in Mary Esther' s
contract last year. Additionally, while I would like to see the entire indemnity section deleted or
eliminated, Transfield was unwilling to do this in Mary Esther' s contract.
