TRAFFIC CONTROL /SAFETY: The Contractor shall perform all work, including the operation of equipment, in a manner which will not endanger the life or safety of individuals at the work site or the users of the facility. The Contractor shall comply with Florida Safety and Health Standards. All traffic control devices shall conform to and be placed in accordance with the requirements of the Federal Highway /State Manual on Uniform Traffic Control Devices for Streets and Highways. AUTHORITY OF THE PROJECT MANAGER: The Transfield Services Project Manager, acting either directly or through their duly authorized representatives is the responsible person for Transfield Services. The Project Manager will evaluate the work of the Contractor for general conformity to the Contract. All work shall be done to the satisfaction of the Project Manager. Contract 4 4600001084- Page 1 of 17 8  4.1 a..' t WORK ACCEPTANCE: Upon completion of the assigned work the Contractor will notify the Project Manager and certify that the work is completed and that the work quantities and quality were accomplished in accordance with the Contract. All work completed will be reviewed to verify quantity and quality prior to accepting the Contractor' s certification. INDEMNITY: The Contractor shall indemnify, defend and save and hold harmless the State u Department of Transportation, Transfield Services and all of its officers, agents and employees from all suits, actions, claims, demands, liabilities of any nature whatsoever arising out of, fA because of, or due to breach of this Contract by the Contractor or the willful misconduct or negligence of the Contractor or any of its officers, employees, agents, or representatives. The 3 o parties agree that 1% of the total compensation to the Contractor is the specific consideration ` from Transfield Services for the Contractor' s indemnity agreement and the parties further agree that 1% is included in the contract amount. of Quantities presented in this bid are approximate and are to be used for estimating and bid o u. analysis purposes only. Transfield Services makes no guarantee as to the accuracy of these quantities. The quantities may be minimal, increase, decrease or be omitted due to any G conditions and for any reason. INSURANCE: The contractor must provide proof of General Liability Insurance in the amount of fUNd 1, 000,000 combined single limit; Worker' s Compensation in the amount of $ 100,000 each yu accident, $ 500,000 combined single limit, $ 100, 000 each employee; Vehicle Liability Insurance av in the amount of $500, 000 combined single limit. Failure of the Contractor to keep insurance in N force will be grounds for termination of the contract. r The Contractor shall have Transfield Services and the State Department of Transportation r named as additional insured for the General Liability and Automobile insurance coverage.
