STATEMENT OF ISSUE: Mr. Lannie Corbin, City Manager of Niceville, has requested that
Okaloosa County assign the easement rights to the City of Niceville for an easement along
Rocky Bayou (within the city limits).
BACKGROUND: On July 12, 1991 Okaloosa County was granted an easement from ECMA
Forest Investors, LTD on the south side of Rocky Bayou west of the bridge. The easement was
granted to the County for use by the general public to have pedestrian access to the water. Mr.
Lannie Corbin, City Manager of Niceville, has requested that the easement be assigned to the
City of Niceville.
The parcel of land in question was annexed into the City of Niceville in December of 2007.
Public Works and Parks staff have no plans for improvements to the property and have no
objection to the request from the City of Niceville. A copy of the letter requesting the
assignment, the original easement and annexation documents were provided by Mr. Corbin and
are included herein for reference.
To perform the easement assignment the Board of County Commissioners would need to
approve a Resolution authorizing the assignment to the City of Niceville. Public Works staff has
coordinated with the County Attorney in developing the necessary documents for consideration
by the Board of County Commissioners. The proposed Resolution and all necessary supporting
documents are attached for reference.
OPTIONS: Approve/Deny the request from Mr. Lannie Corbin, City Manager of Niceville, for
the assignment of easement rights for an easement along Rocky Bayou within the City of
Niceville.
RECOMMENDATIONS: Approve the request from Mr. Lannie Corbin, City Manager of
Niceville, for the assignment of easement rights for an easement along Rocky Bayou within the
City of Niceville and authorize the Chairman to execute the included Resolution and Assignment
of Easement form.
