1st 2nd ORDINANCE 1814 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA, RELATING TO THE REZONING OF PROPERTY LOCATED AT 34 CARSON DRIVE SE, FORT WALTON BEACH, FLORIDA; PROVIDING AUTHORITY; MAKING FINDINGS OF FACT; REZONING PROPERTY FROM R- 2 MULTIFAMILY RESIDENTIAL DISTRICT TO CF COMMUNITY FACILITIES DISTRICT; PROVIDING FOR A ZONING MAP AMENDMENT; AND SETTING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. The authority for enactment of this ordinance is Section 2, of the City Charter, and Section 166. 021( 1), Florida Statutes. SECTION 2. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach finds that Cecil Williams, as the authorized agent for the property at 34 Carson Drive SE, Fort Walton Beach, Florida, applied for rezoning of the subject property. The subject property comprises three parcels and . 75 acres more or less. A public hearing was held before the Municipal Planning Board on October 15, 2009, and the Municipal Planning Board recommended the request be approved. The City Council conducted two public hearings after giving due public notice pursuant to Section 166. 041, Florida Statutes, and the City' s Land Development Code. The requested rezoning is consistent with the City' s Comprehensive Plan. SECTION 3. PROPERTY REZONED. The property legally described as Lots 10, 11 and 12, Block 1, Brooks Addition to Fort Walton Beach, according to the plat thereof on file in Plat Book 1, Page 99, in the office of the Clerk of Circuit Court, Okaloosa County, Florida, is hereby rezoned CF Community Facilities District. SECTION 4. ZONING MAP AMENDMENT. The Official Zoning Map of the City of Fort Walton Beach, as adopted by Section 12. 40. 06 of the Land Development Code, is hereby amended to include a change of classification from R-2 Multi- Family District to CF Community Facilities District for the specific parcel described in Section 3 of this Ordinance. SECTION 5. EFFECTIVE DATE. This Ordinance shall become effective upon approval by the City Council and signature of the Mayor. ADOPTED:~~~ r.f~ ;~?
