BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: December 15, 2015 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Public Hearing for Resolution to Use Non-Ad Valorem Collection for Code Enforcement DEPARTMENT: Growth Management BCC DISTRICT: All STATEMENT OF ISSUE: Conduct a public hearing to consider adoption of a resolution providing notice of the intent to use the Non-Ad Valorem Collection to recover the cost of the abatement of nuisance and Code violations from properties as authorized under section 197.3632, Florida Statutes. BACKGROUND AND ANALYSIS: The Board has previously directed staff to revise the code enforcement provisions of the County Code to provide more effective enforcement and to allow the County to recover the cost of the abatement of nuisances and Code violations from subject properties through the use of the Non-Ad Valorem Collection process as authorized under section 197.3632, Florida Statutes. Staff has prepared the necessary changes which are currently under review by the Board. In addition to revising the Code, in order for the County to be able to use the Non-Ad Valorem Collection process, the Board must also adopt a Notice of Intent to Use the Non-Ad Valorem Collection process which is a resolution. The resolution must be adopted prior to January 1, 2016 in order for the Non Ad-Valorem collection process to be available in 2016 (that will be collected in 2017 taxes). The primary purpose of the Notice of Intent resolution is to notify the Property Appraiser and Tax Collector that assessments may be imposed. The adoption of this resolution will not commit the Board to actually go forward with the adoption of the ordinance or even actually impose the assessments; however, if this resolution is not adopted, then the Board will not have the option of including and collecting those assessments on the ad valorem tax bill. During its regular meeting of October 20, 2015, the Board of County Commissioners set a public hearing date of December 15, 2015 to consider the resolution, and authorized the requisite advertisements which were run in the Northwest Florida Daily News on November 2, 9, 16, and 23, 2015. OPTIONS: The Board may choose to adopt or not adopt the attached resolution. RECOMMENDATIONS: Staff recommends that the Board conduct the public hearing and then adopt the Resolution providing the County’s Notice of Intent to Use the Non-Ad Valorem Collection Process to recover the cost of the abatement of nuisance and Code violations. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
