He said they need to select one person to do the job. The Mayor made the observation that the budget process will start during this time also for next years budget so he thought the key is continuity. Mr. Garvie mentioned he served on another board where there is a similar situation where if the CEO r is sick, on vacation, or leaves for another job there is always one person who everyone knows is going to be the person in charge, and it is important to know that. He also wondered why someone is not designated as an Assistant City Manager and said there should be someone who takes that position when the City Manager is not here and Council has the right to know who that person is who will be in charge during that time. He commented that person does not have to receive extra money but it should be considered in a bonus situation, although he felt they should receive additional salary for the responsibility. He did not believe it should rotate around even though it does make more people qualified it creates a lot of commotion. He said they need stability and having one person at all times who would be the fill -in for the City Manager, no matter what happened creates stability for the employees, Council, and the residents. 90 Special Council 12/ 22/ 08 ACTING CITY MANAGER ( CONT) The Mayor asked if there is a provision for an above and beyond additional salary compensation. The City Manager believed the Mayor is referring to the out -of -class pay for an employee acting in a step - up position and will receive between 5 -15% during that particular time. She said that is something Council would have to specifically designate as it is not something that is automatically done for this particular position. Mr. Reeves recalled a former City Manager who volunteered services at one point and wished to know if there is someone in the local Range Rider program who might be a retired City Manager who would step into the role. The City Manager noted at one time Mr. Keeler and Mr. Ingram were in town but believed Mr. Ingram has moved away and she has not heard from Mr. Keeler in quite some time. Dr. Pullen commented there are a lot of highly qualified people in the area who have been managers before that can be named as a temporary City Manager. He mentioned one person he thought is highly qualified is Joe Taylor who held a very high management position on base and thought if he were asked he would act as Interim City Manager, probably at a very reasonable cost that would not cost the City much. He would like to put his name forward. The Mayor noted Council has to decide if that is the way they want to go, internal or external, and if Council goes the external route then they can discuss how to go about the process of selecting someone. The Mayor opened the floor for public input. As no one wished to speak public input was closed. Mr. Garvie moved to appoint an Interim City Manager from the current staff, only one person to act in that position. Motion failed for lack of a second. Dr. Pullen moved to name someone from the community to be Interim City Manager. Motion failed for lack of a second. Mr. Miller moved to advertise immediately for an Acting City Manager, and discuss the terms with Mr. Wiltsie and get that person on board as soon as possible. Mr. Reeves seconded motion. Mr. Miller believed there are people in the area who have experience and thought they need someone with management and people skills to get the people working together. He thought the talent is here in the local area to get someone to come in to serve the City for three or four months. Mr. Reeves mentioned he has been approached by several high -powered people from the military base who are not doing anything right now and agreed it would give Council an opportunity to talk to a few of them who, he feels, are over -qualified and he would like to give them an opportunity. He agreed there is a lot of local talent. He said two Mr. Minich wished to know how long it will be advertised and when Council will decide. 13tH weeks would be sufficient to make the decision on January Dr. Pullen received clarification from Mr. Miller that the motion is intended to recruit outside in the local community for candidates for the Acting City Manager position. The Mayor called for the vote on the motion to recruit outside in the local community for the Acting City Manager position and it carried by a vote of 5 to 2 with Miller, Reeves, Pullen, Hartwell, and Minich in favor and Holmes and Garvie opposed. 91 Special Council 12/ 22/ 08 ACTING CITY MANAGER ( CONT) It was suggested the City request the local citizens submit a resume and Council make a decision at 13th 6th the January Council meeting based upon the resumes received by January to provide time to put in the agenda package. It was mentioned the announcement should answer the candidates' expectations on pay and whether or not there are benefits. It was agreed that the pay is negotiable, that no benefits be offered, and that the resume state the salary requirements. 6th The Mayor clarified it was agreed on January as the suspense date to receive the candidates 13tH resumes with Council to make the selection of an Acting City Manager on January Dean Covey, 270 Brooks Street, wondered if there will be interviews as part of the process and expressed his thought that an interview of the top candidates would be appropriate. 6th 13th Mr. Reeves asked if possibly between January and Council could set up a time to meet with the candidates. Mr. Hartwell suggested a Special meeting to give an opportunity for an interview with five minutes per candidate. Mr. Minich commented Council' s phone numbers are readily available and if someone wants the job they can contact them or go see them, or Council can call them when an application is submitted. He believed there will be a list of recognizable names and Council can call to talk with them. He said to go through a formal interview process is stretching it out and it is for an interim job. Dr. Pullen commented if it does not work out Council can fire them. The Mayor mentioned there is another point, there is an expectation on the length of the job that needs to be in the announcement. The City Attorney noted, based on the Charter, Council is limited to the appointment of an acting City Manager to two consecutive terms of ninety days and it does need to be in the announcement. She then received clarification that the motion to advertise outside was intended to preclude the current Department Directors or anyone else on staff from applying, no internal candidates. Mr. Wiltsie mentioned on the recruitment locally if it is put on the web site it will be seen all over the Country and wished to know if that is someplace Council would like them to advertise. The Mayor asked Council if they wanted to restrict it to Okaloosa County candidates, or Okaloosa/ Walton candidates. Mr. Minich moved to restrict recruiting to Okaloosa County residents only. Mr. Reeves seconded motion and it carried by a vote of 4 to 3 with Reeves, Pullen, Hartwell, and Minich in favor and Holmes, Miller, and Garvie opposed. I It was explained that Council will select an Acting City Manager on January 13tH to be effective at 5: 00 16tH p. m. January Mr. Wiltsie stated the Human Resources Department will receive the resumes and they will provide them to the Mayor and City Council with a copy to the City Clerk. 92 Special Council 12/ 22/ 08 ADJOURNMENT Being no further business, the meeting adjourned at 9: 00 p. m. APPROVED: MAYOR: ATTEST: CITY CLERK lve /ddm CITY COUNCIL MEETING January 13, 2009 Consent Agenda Consideration of a request to approve a Law Enforcement Memorandum of Understanding ( MOU) by the City of Fort Walton Beach Police Department with the United States Marshals Service Police Chief) Council Action 1 St 2nd Vote: Agenda Item Number: 3 CITYOT TORTWALT05VBEACYI POLICE DEPARTMENT STAFF REPORT MEMORANDUM To: Joyce Shanahan, City Manager From: Ted Litschauer, Police Chief Date: December 31, 2008 Subject: Memorandum of Understanding Background: The Fort Walton Beach Police Department, as well as all other regional City, County, and applicable State Law Enforcement Agencies individually enter into an annual Memorandum Of Understanding ( MOU) with the United States Marshals Service USMS) for the Northern District of Florida. The U. S. Marshals Service provides the MOU for signature by the Chief Law Enforcement Officer of the jurisdiction, which is in our case the Chief of Police. Please find the attached copy of the MOU document, along with a separate document addendum numbered VFTF -09 -1706. The Memorandum of Understanding ( MOU) has traditionally been an annual document, requiring renewal in the early part of each fiscal year. It will now be changed to be a continually operating MOU, unless /until one of the parties notifies the other —in writing —that it will be terminated. Only the MOU numbered document will be signed anew, annually, for the purpose of identifying, and agreeing to, the limit established by the Marshals Service. The MOU provides that USMS will compensate Fort Walton Beach Police Department for actual overtime expenses, not to exceed $ 15, 572. 00 per officer, per year. Such reimbursements are contingent upon proper invoicing procedures. The annualized MOU numbered document provides that the maximum amount that the USMS will compensate Fort Walton Beach Police Department for actual overtime expenses in FY -2009 will not exceed $ 30, 000.
