From: Stewart, Greg To: Ernie Padgett; Rick Owen Cc: Kelly Windes; John Dowd; Hoshihara, Lynn Subject: Public"s Right to be Heard Statute Date: Wednesday, January 08, 2014 10:17:22 AM Attachments: Resolution - public participation.doc We have had several inquiries concerning the implementation of the provisions of section 286.0114, Florida Statutes dealing with the public’s right to be heard. Our interpretation of the statute is that a formal policy needs to be adopted to implement the procedures of the statute and place guidelines on public comment. We have previously prepared a similar resolution for the TDC which was approved at their December meeting. We have attached a draft resolution for your consideration on the matter. It is in conformity with the statute and is consistent with the “informal” policy that has been applied since the effective date of the statute. If you have any questions, please feel free to contact either Lynn or myself. Gregory T. Stewart 1500 Mahan Drive, Suite 200 Tallahassee, Florida 32308 (850) 224-4070 Tel.
