BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: July 6, 2016
TO: Honorable Chairman and Members of the Board
FROM: Jason Autrey
SUBJECT: Public Hearing to Amend Resolution 09-108
DEPARTMENT: Public Works
BCC DISTRICT: 3
STATEMENT OF ISSUE: A request by Teramore Development, LLC to revise the stipulations
under Resolution No. 09-108 by modifying stipulation 1and removing stipulation 2.
BACKGROUND: Teramore Development, LLC desires to develop a parcel of land located in
Holt for a Dollar General Store. The Board of County Commissioners approved an alleyway
vacation through this parcel at a regular meeting on July 7, 2009. The approval of the alleyway
vacation under Resolution No. 09-108 is subject to two (2) stipulations. Teramore Development,
with authorization from the owner in the attached purchase agreement, would like to modify
stipulation 1 and remove stipulation 2 of the resolution in order to make a viable use of the
property and meet the design requirements of the proposed development.
The proposed revision to stipulation 1 would require the owner of the parcel to coordinate with
utility companies to relocate existing infrastructures, if there is any, at the owner's cost. The
proposed removal of stipulation 2 would allow the construction of the building on the vacated
right-of-way.
OPTIONS: Approve/Disapprove
