BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: July 7, 2015 TO: Honorable Chairman and Members of the Board FROM: Ed Schroeder SUBJECT: TDC Term Limits Modification DEPARTMENT: Tourist Development Department BCC DISTRICT: 2,4,5 STATEMENT OF ISSUE: Request Board consideration of Tourist Development Council term limit modification. BACKGROUND: When the “new” Council was established in April 2013, three members were appointed to 4-year terms expiring in September 2017 and three members were appointed to 2- year terms expiring in September 2015 to ensure future 4-year term appointments would be staggered. Other Council members include the Board liaison and municipal representatives appointed as desired by their respective governing bodies. Florida Statute 125.0104(4)(e) provides for “staggered terms of 4 years.” Pursuant to section A.500.2 of the Tourist Development Operations & Procedures Manual, “No Council member shall serve more than one (1) term which shall be no more than four (4) consecutive years.” As written, the policy precludes a member appointed for a partial term from serving a subsequent full, four-year term. Staff is in the process of updating the TDD Manual as well as drafting the guidelines for selecting members for three non-elected seats with terms expiring September 30, 2015. As such, staff is seeking Board consideration on modifying the term limit such that current members may apply for reappointment for a second term. OPTIONS: Maintain current Council term limit or provide direction for modification. RECOMMENDATION: Modify Council term limit as follows: Council members shall serve no more than two (2) consecutive terms which shall be no more than eight (8) consecutive years.
