City of Fort Walton Beach
MEMORANDUM
TO: Honorable Mayor and City Council
FROM: Joyce Shanahan, City Manager
SUBJECT: Okaloosa County Judicial Center Annex
DATE: September 21, 2006
BACKGROUND:
The City purchased the property known as the Fairgrounds and Softball Complex
located at 1958 Lewis Turner Blvd. October 26, 2005, at a cost of $ 4, 000, 000 with a
structure height limitation ( from Eglin AFB) of 50 feet; requirement that the use of
electromagnetic radiation devices be coordinated with Eglin AFB; and permitted the
US Forest Service the right to continue to administer its US Dept. of Agriculture' s
Special Use Permit through December 31, 2005.
On July 13, 2006, the City Council convened a special meeting to discuss the site of
the Okaloosa County Judicial Center and possible options to have the Judicial Center
Complex located on City property. The City Council voted unanimously to direct the
City Manager to approach the County to determine their interest in locating the
Judicial Center Annex Extension ( JCAE) on the City' s property.
The City Manager and County Administrator, on subsequent occasions, have met
several times to discuss the extent of the County' s interest in locating the Judicial
Center Annex Extension on City property. The main issues of the conversations were
site suitability and cost. Site suitability was based upon information from the
County' s architect HLM after their preliminary review of the site options. Consistent
with information available in the BOCC Workshop " Judicial Center Site Options"
documentation of July 6, 2006, the City' s 42- acre site could support the Judicial
Center Annex Extension. According to information contained in this report, the City' s
site slopes from north to south with the high point ( 70':t above MSL) located at the
northwest corner of the property. It is comprised of 100% Lakeland sand1 (# 12), 0-
5% slopes and grass covers most of the site; and sanitary sewer and potable water
service are available on this site.
The OWC location is a 21- acre site owned by the college 500' east of Martin Luther
the high
King Boulevard. The site slopes from east and south to north and west; with
42':t above MSL) along the central property line. The site is comprised of 80%
point (
Chipley2 and Hurricane3 Soils # 4 ( somewhat poorly drained soils) and 12% Lakeland
1
The Lakeland series consists of very deep, excessively drained, rapid to very rapidly permeable soils on uplands. They
formed in thick beds of eolian or marine sands. Slopes are dominantly from 0 to 12 percent but can range to 85 percent
in dissected areas. ( US Dept.of National Resource Conservation Service website; soil definitions)

The Hurricane series consists of very deep, somewhat poorly drained, moderately rapid permeable soils on broad
areas that are slightly higher than the adjacent flats of the Lower Coastal Plain. They formed in sandy marine sediments.
Sand and 2% Foxworth sand4. The site is 95% covered by native vegetation ( assumed
to be a mix of pines, oaks, and native grasses) and although sanitary sewer and
potable water service is available, it is not currently stubbed out to the property.
Comparability of costs between the OWC- site and the FWB- site was the principal issue
of discussion between the managers. The OWC- site is being offered at a perennial
lease with a nominal cost of $ 10 per year; however the costs to mitigate the existing
soil conditions as described above was important in determining the actual or full cost
to build on this property. The County Administrator agreed to have their architect
proceed with soil borings and samplings to determine the costs to remedy the soil
conditions in order to produce a buildable site.
On September 20, 2006 the County received the site analysis and estimated
remediation costs for the OWC site. Based upon information presented to the County
Commissioners at their Workshop Session on September 21, 2006, it will likely cost
about $ 2. 0 million in site work for the OWC property, as detailed as follows:
COMPACTED FILL $ 1, 213, 325
EXTEND SANITARY SEWER $ 178, 200 ( 89, 100)
EXTEND WATER SERVICE $ 187, 500 ( 93, 750)
MLK BLVD. ROAD IMPROVEMENTS $ 200, 000
GEN. CONDo & MARK- UPS $ 213.483
POTENTIAL COST $ 1, 992, 508
Discussion ensued meeting with regards to extension of water and sewer
at the
service to this property. The County was advised by their Public Works Director that
if the extension work to the OWC property was performed while the Hurlburt Road
reduced
project was on- going that the costs for water and sewer extension could be
to $ 1, 809, 658. Because the cost data to mitigate
by 50%; revising the potential costs
the site was not available prior to September 20th, the City Manager and County
Administrator did not have any discussions about purchase price of the City' s
property.
At their September 21, 2006 workshop, the County Commission expressed modest
continued interest in the FWB property and asked that the City come forward with an
offer and site location at their earliest convenience. The County is expected to move
forward in their decision- making process on October 3, 2006.
DISCUSSION:
If the City Council remains interested in seeking to gain County Commission
endorsement in locating the Judicial Center Annex Extension on property situated at
Lewis Turner Blvd., then parameters for negotiations need to be established and
where the negotiations fit in with the City' s Master Planning process for this parcel
need to be add ressed.

requests for proposals to
