Subject: Bluewater Bay Annual 2015 Assessment and FY16 Budget

Dear Bluewater Bay MSBU Board members,
The FY2016 Bluewater Bay budget letter addressed to Commissioner Boyles and dated June 12,2015
states a duly noticed public meeting was held; however since the Property Appraiser would not
accept the proposed $66 per unit annual assessment due to the late date in which they received the
request, and since notices were not mailed to individual units as per the State Statutes, a new
submittal is requested for the Board Chairman with a corrected assessment amount and
corresponding budget. Once an updated submittal is received, the item will be provided to the
Board for approval.
Please take into consideration the FY16 Bluewater Bay MSBU budget does not address the
remaining payment due the County for sidewalks completed and invoiced November, 2014 in the
amount of $14,720 nor does it address Reserves.
Kindest Regards,
Ann Halbert, Public Works Coordinator

Felix – I have received a copy of the proposed budget for FY 15-16. Based upon my review and
discussions with staff, it appears that there is a contemplated increase in the special assessment for
the Bluewater Bay MSBU. Based upon the ordinance and my understanding of the history of this
assessment, it is collected on the ad valorem tax bill. The statutory requirements for the collection
of an assessment on the tax bill are contained in Section 197.3632, Florida Statutes. As there is an
increase in this assessment, to approve it and place it on the tax bill, there will need to be a public
hearing held and that meeting will be required to be noticed by individual mailed notice of the
increase to each property owner subject to the assessment and a newspaper advertisement. The
statute sets forth what is required to be included in each of the notices. I also note that though the
ordinance designates the BOCC as the governing body of the district, it delegates to responsibility of
setting the assessment to the Board of Directors. Apart from my legal concerns about this
delegation, it appears that for the current year, that the Board of Directors will need to comply with
Florida Statutes to increase the assessment amount. I have attached a copy of the statutory
provision for your assistance. We are willing to assist you in this process and if you have any
questions, please contact either Lynn or myself. On another note, having gone through the
ordinance and as we discussed several months ago, I believe the Ordinance will need to have some
revisions to address some issues. Perhaps after we get through this budget process, we can
schedule a time to discuss the ordinance and possible changes.
