STATEMENT OF ISSUE: An amendment is requested for consideration by the Board of
County Commissioners identifying units of measure for purchased Asphalt Tack Material.
BACKGROUND: On October 1, 2013 Okaloosa County and C. W. Roberts entered into
agreement C14-2083-PW for Asphalt Materials with one (1) approved renewal. Through the
course of the contract, invoices reflecting a cost for Tack Material have proven difficult to pay
because of available methods of delivery.
Tack material is available in five (5) gallon buckets or delivered per gallon utilizing a tack
emulsion distributor. The material is billed at a rate of $5 per gallon picked up and $6 per gallon
delivered. The current contract only allows for payment on individual gallons and does not
allow for the purchase of "Tack Buckets".
Staff currently holds five (5) invoices with Tack Buckets billed that cannot be processed due to
the technical discrepancy with the contract. To prevent further delays in payments and hand
modifications to invoices that would allow payment, the attached contract amendment is
requested. Exhibit "A" of Amendment One represents the necessary changes to the agreement to
rectify the billing issues.
This contract amendment has been reviewed and approved through the County Attorney. The
request herein is only for the amendment, the request to renew the contract will come at a later
date.
OPTIONS: Approve/disapprove the requested contract amendment.
RECOMMENDATIONS: Staff requests Board of Commission execute Amendment One to
Contract C14-2083-PW retroactive to July 1, 2014 with C. W. Roberts Contracting, Inc., and
authorize the Chairman to sign the Amendment.
