BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: December 4, 2012 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Letter of No Objection for School District Niceville Property Rezoning DEPARTMENT: Growth Management BCC DISTRICT: 5 STATEMENT OF ISSUE: Approval of Letter of No Objection to the City of Niceville Regarding Proposed School District Rezoning Application BACKGROUND: The City of Niceville has received an application from the Okaloosa County Public School District to rezone a small portion of School District property located at 800 John Sims Parkway East (site of Niceville High School) from R-1A (Residential Single Family) to R- NC (Residential/Neighborhood Commercial). The portion of the subject parcel for which the rezoning has been requested is the ground underneath the large sign at the end of the football field nearest SR 20. The area to be rezoned is approximately half an acre. The School District has requested this rezoning in response to FDOT's determination that it could not issue a billboard permit for the existing sign if the underlying property retains its residential classification. Okaloosa County received notification of the proposed rezoning due to the Board of County Commissioners' ownership of a small (less than 10,000 square foot) parcel (07-1S-22-1130- 0008-0010) located on Cedar Avenue South that is within the limits of the City's notification requirements. Staff has reviewed the proposed rezoning and has determined its approval will have no negative impacts on the BCC's property or interests. In response to the notification, staff has developed the attached letter to the City Clerk advising the City that the County has no objections to the proposed rezoning. RECOMMENDATIONS: Staff recommends that the Board of County Commissioners authorize the Chairman to execute the attached letter and send it to the City of Niceville. A copy of the letter on Board of County Commissioners letterhead will be available at the Board meeting. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
