that they and their staff monitor all the time and if there' s something better that is going to come alongor if there is another option or something that's going to be better for us, they' re going to bring it to us. And I don' t know that we have to necessarily instruct them all the time to look at a special thing that has been ongoing for three or four years. Thank you Mayor. Mayor Anderson - Mr. Miller? Virgil Miller - well I didn' t volunteer to submit my name for election to this position to sit back and not make a difference. You know we can do business the same old but I didn' t come on this Council to do business the same old way. I've had some experience in dealing with these different types of businesses. All I did was ask questions. If people are unhappy or uncomfortable giving answers, then I think they need to look for a job some place else. I've had a good relationship Mayor Anderson - Okay I think now, you' re getting out of line now. Mike Minich - way out of line Dr. Pullen - excuse me, I believe the Mayor is running the meeting. Mayor Anderson - so back to the motion, back to the motion on the table. Virgil Miller - Mr. John Hofstad did an excellent job, you know. And somehow I've taken heat from both sides of me. That doesn' t bother me one bit. I will continue to ask questions. I mean that's my job. Are we doing it the right way? We have dollars at stake, big dollars. And I'm not going to He has show that in writing in Florida Statute change. I don' t care what the Mayor says. to me some because I haven' t seen it yet and I will continue to do this job Mike Minich - Mr. Mayor, I have a point of order. Mayor Anderson - now again, back to the motion. Virgil Miller - Okay, I will support the motion because I believe we need to complete the construction in hand. Is drawings. But I do not think we should continue past that until we have all the infonnation that sufficient? 9 of 12 COUNCIL MEETING 10- 9- 07 Mayor Anderson - thank you. Anyone else like to speak? Dr. Pullen? Dr. Pullen - I will completely support Mr. Miller. We have a responsibility to know what goes on in the City and every portion of the City. And I've been, someone even tried to censor me one time because I was asking too many questions. I'm sure glad Mr.Miller Mike Minich - point of order Dr. Pullen - we don' t have a point of order Mr. Minich Mayor Anderson - hang on please Mike Minich - I believe the Mayor' s running the meeting Dr. Pullen. Dr. Pullen - we suspended Roberts Rules. Mayor Anderson - Dr. Pullen, back to the motion. Dr. Pullen - ( inaudible) Mayor Anderson - okay, it is completely out of order. Okay, any other comments on the motion? Okay seeing none please vote. It does pass unanimously. Thank you. MAYOR/COUNCIL ANNOUNCEMENTS Virgil Miller - I have an item which I nearly forgot. I'd like to make a motion, he reminded me, I'd like to make a motion and also this conforms with what the City Attorney mentioned earlier, that I move that the Presidio be afforded the option to use pavers in the construction of the boardwalk on their property, subject to the approval ofthe City staff. Mayor Anderson - is there a second to Mr. Miller' s Bill Garvie - I'll second that Mayor Anderson - okay, Mr. Miller made the motion and Mr. Garvie seconded it. Go ahead sir. Virgil Miller - well they approached me, they said they had talked with Missy McKim and Malcolm Foley about this that once they looked at their plans they thought maybe would go ahead put the added the process because they were expense and putting in pavers but they did not want to go back through concerned about the Certificate of Occupancy. And this will give them the option to present that design and the permit, and so then the City staff will get a chance to either approve it or deny it. Mayor Anderson - Mr. Garvie Bill Garvie - the reason I went ahead and seconded that is because he did put into that motion the fact that City staff would have the opportunity to look at what they would like to use as pavers and make sure that that met all the City requirements. 10 of 12 COUNCIL MEETING 10- 9- 07 Bill Garvie ( cont) - And I think that the condominium project, the Presidio itself should have the right, as long as it conforms to what the City wants, to put something in that they think matches up with their decor. Mike Minich - I don' t have any problem with them doing pavers but that's something that ought to be brought forward in their request. This is not the forum, they talked to Mr. Miller about it but they don' t want to waste time because they don' t want to go back through the process. I don' t want to waste time on Presidio either but there is a process and e should follow the process. So I will not support this motion. Mayor Anderson - okay, anyone else speak on this? Ms. Craig City Attorney - yes, I have to give my legal opinion so I can say I did. We' re dealing with an issue with a lack of parity of the order. We had a Development Order that required the design to go back to the CRA and so basically what you' re doing is amending the provisions of a Development Order. That Development Order was issued in a quasi-judicial proceeding and we don' t have any of the parties here before us right now and so I would caution that this is not the right forum to address this issue. I would suggest if the Presidio does want to use pavers and that's not a problem; that they need to address that through the staff, at least present it, and bring it back to the CRA because I don' t know if they presented that before. But again that is a QJ matter that we were, just by motion you' re changing the requirements of a Development Order. Mayor Anderson - so is it a valid motion? City Attorney - I can' t say that it' s not a valid motion but I question whether or not it would be a legally sufficient motion on the other side, you know, whenever we let the staff and the developer know because those are the two parties that would actually have to come back before you. And I don' t know that they would agree or disagree, but I am saying that it's, it's not in violation, it's changing the terms of a Development Order that you already have in place. Mayor Anderson - thank you for that clarification. Virgil Miller - it doesn' t bother me Mike Minich - I believe that Mayor Anderson - any other discussion? Please vote and it does fail 5 to 2 with Mr. Miller and Mr. Garvie voting for it. Any other business? Mr. Minich? Mike Minich - thank you, I think this is pretty much an example of how some people don' t believe we have processes and one individual, a City Councilman, go around to talk to developers and bring something forward to us. The processes that we are supposed to follow are clear. I agree fully with Dr.Pullen that we have the right and we should ask questions. But we shouldn' t circumvent the job of the City staff, that' s their job. We' re not the City staff, we' re the City Council. We don' t go out talking to developers and they don' t want to take time so we come back and say, oh well we don' t need to do that process. That's just not the right way to do business. That's all. 11 of12 CITY OF FORT WALTON BEACH MEMORANDUM DATE: October 2, 2007 TO: Joyce Shanahan, City Manager FROM: Mark Wiltsie, Human Resources Director SUBJECT: Request for Proposals ( RFP) - Group Medical Insurance Backl!round: As a result of an RFP process in 2000, the City' s medical insurance program was awarded to Blue CrosslBlue Shield (BCIBS) of Florida effective February 1, 2001. Since that time the City has negotiated and renewed coverage with BCIBS on an annual basis. Staff has recently met with representatives from BCIBS to discuss our last 12 months' claims activity and the upcoming renewal effective February 1, 2008. As a result of our last 12 months' claims activity, BCIBS is estimating a 20 to 25% increase in premium to renew the current group medical insurance pro gram. The 2007/ 08 budget included a 10% ( 6. 7% annualized for the 8 months - February 1 thru September 30, 2008) increase for medical insurance. Discussion: With the above information, there are essentially two options for the City at this point. The first option would be to negotiate with BCIBS for the best renewal option, which would include considering alternative plan designs and associated premiums. The second option, and the one Staff considers the most beneficial, would be to remarket the City' s medical insurance program by issuing an RFP soliciting proposals from various medical providers who offer programs in the local area. Staff has recently become aware of other medical insurance providers such as Aetna, United Healthcare and Cigna who have developed a comprehensive network by negotiated contracts with local medical facilities, physicians and pharmacies. As such, these companies are able to compete in the local medical insurance market in regard to coverage and premium. As with the 2000 RFP effort, Staff would suggest using the firm of Waters Risk Management to assist Staff in developing, issuing and analyzing the proposals as part of the RFP process. This is a consulting firm and does not sell, market or endorse any insurance company and as such can offer an unbiased recommendation to the City for our group medical insurance program. Their proposal to perform these services is attached 1 and includes a proposed flat fee of $10, 500, including expenses, and a timetable for the remarketing exercise. Recommendation: Based on the above, I respectfully request City Council authorize Staff to remarket the City' s medical insurance program and authorize the City Manager to accept the proposal from Waters Risk Management to assist in the RFP process for a flat fee of $ 10, 500. If approved, there are sufficient funds in the 2007/ 08 contingency fund for this expense.
