ADJOURNMENT: 7: 33 pm Approved: Mayor: CNJ Attest: o m0 City Clerk Ci,, Cmmcp fForr Wahan Beach N, 7 2 City Council of Fort Walton Beach POLICE MEMORANDUM To: Michael D. Beedie, City Manager From: Ted Litschauer, Police Chief Date: January 22, 2013 Subject: USMS Annual Obligation Document 1. BACKGROUND: 1. 1. The Fort Walton Beach Police Department ( FWBPD) has a continuing Memorandum Of Understanding ( MOU) with the United States Marshals Service ( USMS or Marshals Service) for the Northern District of Florida. 1. 2. The Operational Memorandum of Understanding ( MOU) was established as a continuing document, with a provision for cancellation by either party. 12. 1. Only a numbered document establishing the maximum reimbursable amount from USMS will be signed anew, annually, for the purpose of identifying, and agreeing to, the limit established by the Marshals Service. 1. 2. 2. The Obligation Document, JLEO -13 - 0246, covers the period of Fiscal Year 2013. 1. 2. 3. This Obligation Document provides that USMS will compensate the City of Fort Walton Beach Police Department for actual overtime expenses, not to exceed $ 5, 000 for the year. Such reimbursements are contingent upon proper invoicing procedures. 1. 2. 4. The Marshals Service provides the Obligation Document for signature by the Chief Law Enforcement Officer of the jurisdiction, which is the Police Chief. 1. 3. The Fort Walton Beach Police Department has participated in this program with the United States Marshals Service since October 2001. 2. DISCUSSION: 2. 1. MOU documents providing for overtime payroll reimbursements require City Council approval and authorization by City Council for the Chief of Police to sign it. This is an annual obligation document for the existing operational MOU. A newly numbered appropriations document is to be executed annually to reflect agreement on the maximum amount of reimbursement during the fiscal year. This document is for Fiscal Year 2013. 2. 2. It is in the best interest of the City of Fort Walton Beach and its citizens for the police department to work well with other law enforcement agencies, including the United States Marshals Service. It is prudent to have a current Memorandum of Understanding MOU), to guide the actions of the various agencies as they work together, and to Page 1 of 2 e:? annually execute an addendum to establish agreement on the amount of appropriations /reimbursements. 3. FINANCIAL INFORMATION: 3. 1. The following budget amendment will be required to record the MOU revenue and expense: Revenue Expense 001 - 1504- 331 - 2061 $ 5, 000 001 - 1504 -521 - 1211 $ 5, 000 3. 2. No direct City match is required for this MOU; however, only overtime wages are reimbursed. Therefore, the City will have to fund the Social Security, Medicare, retirement, and workers compensation benefits associated with participation in this task force. These benefits are 49. 501% of overtime and are estimated at $ 2, 475. Funding will be reallocated from other line items in the Police Department' s budget. 33. The grant agency is no longer funding Marshals- related vehicle fuel & maintenance. These costs will be absorbed by the Police Department's budget. 4. RECOMMENDATION: 4. 1. Staff respectfully recommends City Council approval of the Fiscal Year 2013 Memorandum Of Understanding with the United States Marshals Service for the Northern District of Florida appropriations document, set at a maximum of $5, 000, and authorization for the Police Chief to execute the document. 4. 2. Staff also recommends City Council approval of a budget amendment to record the MOU revenue and expense.
