BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: July 19, 2016 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Okaloosa Lane right-of-way acquisition DEPARTMENT: Public Works BCC DISTRICT: 1 STATEMENT OF ISSUE: As part of the project to improve Okaloosa Lane from the current dirt road condition to a two lane paved road, it is necessary to acquire adequate right-of-way. Staff is working to acquire the necessary land to accommodate the improvements. An agreement, in principle, has been made with Ms. Terri Ann Bailey and staff requests approval from the Board of County Commissioners to accept and record the deed to acquire the right-of- way. BACKGROUND: The proposed paving of Okaloosa Lane requires right-of-way from adjacent property owners along this county maintained roadway. Depending on the location of the property owner and the existing roadway, the amount of right of way required varies from parcel to parcel. Ms. Terri Ann Bailey owns a 15 acre parcel, number 22-3N-23-0000-0067-0000, of which 0.96 acres of right-of-way is required to accommodate the roadway. The appraisal performed for this parcel determined a value of $19,700 for the necessary right-of-way and an additional acre for a retention area. Ms. Bailey opposed the land acquisition for a retention pond and staff was able to re-permit the project with the Northwest Florida Water Management District to eliminate retention areas for the Okaloosa Lane roadway improvements. Most tracts of land needed for the Okaloosa Lane roadway project are 0.2 acres or less. The County has paid as much as $1/ square foot to obtain other parcels along the roadway. The appraised value of $19,700 for Ms. Bailey's property would equal 47 cents/ square foot. Ms. Bailey has agreed to grant the Board of County Commissioners the 0.96 acres of right-of-way by executing a deed in consideration of $25,000.00 for her property. If the board approves the acquisition, the cost would equal 60 cents/ square foot. By acquiring this right-of-way, staff can continue to move forward with the planned improvements to Okaloosa Lane. Funds for right-of- way acquisition are available as part of the existing project budget. OPTIONS: Approve/Disapprove acceptance and recording of the deed for the acquisition of right-of-way in parcel 22-3N-23-0000-0067-0000 from Ms. Terri Ann Bailey in the amount of $25,000.00 as part of the Okaloosa Lane improvement project. RECOMMENDATIONS: Approve acceptance and recording of the deed for the acquisition of right-of-way in parcel 22-3N-23-0000-0067-0000 from Ms. Terri Ann Bailey in the amount of $25,000.00 as part of the Okaloosa Lane improvement project. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
