A INC A MNicholsSBrad E Embry Clerk of Circuit Court Okaloosa County, FL }_ ORDINANCE 2170 12nd AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA, ANNEXING INTO THE CITY LIMITS OF FORT WALTON BEACH, FLORIDA, A PARCEL OF LAND SITUATED IN THE UNINCORPORATED AREA OF OKALOOSA COUNTY, MORE PARTICULARLY DESCRIBED IN THE BODY OF THE ORDINANCE WITH A PHYSICAL ADDRESS OF 627 COUNTRY CLUB AVENUE NE, FORT WALTON BEACH, FLORIDA; PROVIDING FOR MUNICIPAL BOUNDARY; AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on October 28, 2024, the Growth Management Department received an application for voluntary annexation of property located at 627 Country Club Avenue NE into the City limits of Fort Walton Beach, Florida; WHEREAS, 627 Country Club Avenue NE is currently a lot under construction for a single- family residence; WHEREAS, Chapter 174. 044 & 174. 043 of the Florida Statutes dictates the process for voluntary annexations and provides the criteria for a property to be considered for annexation; and WHEREAS, Staff has conducted an analysis of the 627 Country Club Avenue NE property pursuant to the criteria outlined in Florida Statutes and has determined that the necessary annexation criteria are met to legally annex the property into the City of Fort Walton Beach, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WALTON BEACH, FLORIDA: Section 1. Authority and Intent The authority for enactment of this ordinance is contained in Chapter 166. 021( 1) and 171. 044 of the Florida Statutes, and Section 2 of the City Charter. Section 2. Findings of Fact The City Council of the City of Fort Walton Beach hereby finds the following: The City received an application for voluntary annexation from the owner, Barber Custom Builders, Inc. The applicant has provided sufficient evidence of ownership of said property to be annexed. The subject property is contiguous to the municipal boundaries of the City of Fort Walton Beach, is an area that is reasonably compact, and is unincorporated territory. The annexation of subject property will not result in the creation of any enclaves. The notice of annexation was duly published once a week for two consecutive weeks in the Northwest Florida Daily News, a newspaper published within the City of Fort Walton Beach. Upon adoption, this ordinance will be filed with the Okaloosa County Clerk of Court, the Okaloosa County Administrator, the Ocean City -Wright Fire Control District, Okaloosa County Property Appraiser, Okaloosa County Tax Collector, and the Florida Department of State.  DOC # 3733224 Page 2 of 14 01/ 16/ 2025 04: 55 PM Section 3. Property Annexed The following described property is hereby annexed into the City of Fort Walton Beach: 627 Country Club Avenue NE: PARCEL ID 36 -1S -24- 0540- 000B- 0130 LOT 13, BLOCK B, COUNTRY CLUB ESTATES The total actual acreage of the above-described property is approximately 0. 34 acres. At the time of the annexation, the property is under construction for a single-family residence. Section 4. Effect of Annexation The area annexed shall be subject to all laws, ordinances, and regulations in force in the City of Fort Walton Beach and shall be entitled to the same privileges and benefits as other parts of the City of Fort Walton Beach upon the effective date of the annexation. The City of Fort Walton Beach is electing to provide all necessary services, including those of the Ocean City - Wright Fire Control District. The area annexed is subject to the Okaloosa County Comprehensive Plan and zoning regulations. Said regulations shall remain in full force and effect until the subject property is designated into a City of Fort Walton Beach Comprehensive Plan Future Land Use Map designation and rezoned accordingly in the City of Fort Walton Beach zoning map. Section 5. Municipal Boundary The municipal boundary lines of the City of Fort Walton Beach shall be amended to include the annexed property described in this ordinance and in the attached " 627 Country Club Ave NE -Exhibit A: Location Map."
