sewer system due to structural degradation during an inspection program several years ago and others have been added to the list of necessary repairs by OCWS staff in subsequent years. The repair of the manholes will cut down on the amount of groundwater being unnecessarily treated at the Arbennie plant (conserving capacity) and will prevent future potential subsidence of the ground surrounding the leaking manholes. The contract will be in effect for two years, with the ability to renew the contract for another two years with the consent of both parties. This mechanism will allow for the rehabilitation of other manholes in the system as the budget allows for the next several years. This extension has been requested by DEO. DEO has requested an updated Activity Work plan accompany the request. BCC approved the Original Modification 9 on July 16, 2013. BACKGROUND: Okaloosa County was allocated $2,255,252 for the regular State NSP and an additional $1,003,183 for the NSP supplemental allocation for rental housing. On November 20, 2012 DEO made an additional award to Okaloosa County in the amount of $715,111.77, which included an award amount of $301,917.73 and $413,194.04 of program income. The Initial Agreement was executed between Okaloosa County BCC and Florida DEO on November 24, 2009. No county matching funds are required. RECOMMENDATION: The Growth Management Department requests that the Board approve the submission of Modification 9 and NSP Workplan Update, authorize the Chairman to sign the modification, and authorize the Contacts and Grants office of the Okaloosa County Clerk of the Circuit Court to transmit the signed Modification and Workplan to the Department of Economic Opportunity under the attached letter. RECOMMENDED BY: APPROVED BY: Ernie Padgett, County Administrator Packet Pg. 180  Department of Economic Opportunity – Neighborhood Stabilization Program Modification to Subgrant Agreement 5/15/2013 MODIFICATION NUMBER 9 TO SUBGRANT AGREEMENT BETWEEN THE DEPARTMENT OF ECONOMIC OPPORTUNITY AND OKALOOSA COUNTY BOARD OF COUNTY COMMISSIONERS This Modification is made and entered into by and between the State of Florida, Department of Economic Opportunity, (“the Department”), and Okaloosa County, (“the Recipient”), to modify DEO/DCA Contract Number 10DB-4X-01-56-01-F18, award dated November 24, 2009 (“the Agreement”). WHEREAS, the Department and the Recipient entered into the Agreement, pursuant to which the Department provided a subgrant of $3,258,435 to Recipient under the Neighborhood Stabilization Program (“NSP”) as set forth in the Agreement; WHEREAS, the Department and the Recipient desire to modify the Agreement; WHEREAS, pursuant to the provisions of Chapter 2011-142, Laws of Florida, the DCA Division of Housing and Community Development was transferred to the Department of Economic Opportunity effective October 1, 2011; and the parties wish to reflect the new name. NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein, the parties agree as follows: Reinstate Agreement 1. The Agreement is hereby reinstated as though it had not expired. Extend Agreement 2. Paragraph 3, Period of Agreement is hereby revised to reflect an ending date of September 30 2014. Revise Activity Work Plan 3. The Attachment 1, Activity Work Plan section of the Agreement is hereby deleted and is replaced by the revised Attachment 1, Activity Work Plan section, which is attached hereto and incorporated herein by reference. Revise Program Budget and Scope of Work 4. The Attachment A, Program Budget section of the Agreement is hereby deleted and is replaced by the revised Attachment A, the Program Budget, which is attached hereto and incorporated herein by reference. Inclusion of an Unmet Need as Addressed in the Original Application 6. The Attachment A, Program Budget section of the Agreement is hereby deleted and is replaced by the revised Attachment A, the Program Budget, which is attached hereto and incorporated herein by reference. 7. This modification to the Subgrant Agreement hereby replaces “Department of Community Affairs” with “Department of Economic Opportunity” where appropriate in context.
