BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: March 17, 2015 TO: Honorable Chairman and Members of the Board FROM: Greg Stewart, County Attorney SUBJECT: Supplementing the Minutes of the February 18, 2014 Board meeting DISTRICT: All DEPARTMENT: County Attorney STATEMENT OF ISSUE: Request approval to supplement and amend the minutes of the February 18, 2014 Board of County Commissioners’ meeting by including a verbatim transcript of the discussion concerning beach cleaning services as part of the official minutes and determine that to the extent there is a conflict between the previously approved official minutes and the verbatim transcript, that the transcript will control. BACKGROUND AND ANALYSIS: At the February 18, 2014 Board meeting, an agenda item was heard concerning the provision of beach cleaning services by the Public Works Department. During the course of that discussion, there was a variety of topics addressed by the Board including the provision of the services by the Public Works Department, the entering into of an Emergency Contract with Sandman, LLC to provide beach cleaning services for sixty (60) days and the settlement of certain litigation. The minutes of that meeting are recorded in Minute Book 70, Pages 239-262. Subsequently, the discussion at the meeting concerning the beach cleaning issues was transcribed by a certified court reporter at the request of Sandman, LLC. In comparing the transcript of the discussion with the previously approved minutes, there was significant discussion that was not included within the official minutes themselves. To make certain that the entire discussion is included as part of the official minutes, the supplementation of the official minutes with the verbatim transcript would provide a complete record of the discussion and the action taken by the Board. As such, we request Board approval to supplementation and amendment of the February 18, 2014 minutes with the transcript attached hereto. OPTIONS: Approve/Disapprove. RECOMMENDATION: Approve the supplementation and amendment of the official minutes of the meeting of the Board of County Commissioners held February 18, 2014 with the verbatim transcript attached to this Agenda Request and that in the event of an inconsistency between the previously approved minutes for that meeting and the verbatim transcript, that the transcript will control and take precedence. 1 RECOMMENDED BY: _____________________________ Greg Stewart County Attorney APPROVED BY: _____________________________ John Hofstad County Administrator 2
