STATEMENT OF ISSUE: Public Works is in the process of replacing a drainage system along
South Avenue and its connecting pipe system to Monahan Drive. In order to accommodate
replacement of this drainage system, construction crews will need to access portions of the
drainage system through private property. A Drainage Improvement and Hold Harmless
Agreement and a Temporary Construction Easement (TCE) is needed to allow the replacement
of the drainage system to proceed.
BACKGROUND: A portion of the drainage system that runs between South Avenue and
Monahan drive runs through a drainage easement on the property of 118 Monahan Drive, owned
by LUPCENKIP, LLC. Sometime in the 1980's, a house was erected on the property that
encroaches into the drainage easement. Staff has worked with the property owner to allow the
structure to remain in the easement. A Drainage Improvement and Hold Harmless Agreement
has been signed by the owners to allow the work to safely occur, while protecting the structure
and allowing it to remain, and holding the County harmless should the structure be damaged
during construction or maintenance activities. In addition, the owners have offered a TCE on
Lots 1, 2, and 3 of, "A Resubdivision of Lots 9-10-11, Block 2, Bella Vista", as recorded in Plat
Book 4, Page 54 of the official records of Okaloosa County, Florida.
OPTIONS: Approve/Disapprove
RECOMMENDATIONS: Approve and allow the Chairman to execute the Drainage
Improvement and Hold Harmless Agreement. Approve the acceptance and recording of the
Temporary Construction Easement to accommodate the reconstruction of the drainage system
between South Avenue and Monahan Drive, Fort Walton Beach, Florida.
